Phil Carnes took $1500 in placement money which was use to get the brand authorized in Walmart. Walmart did not accept the brand. Phil keep the $1500 in placement money he promised to pay back and he also kept 3 cases of wine sample valued @$540.00. Phil owes me $2040.

Incorrect Claims

This claim is factually false. The owner of the company in question has filed this report, and my dealings were with his national sales manager. Our agreement stipulated $1500 for all work related to pursuing placement with Walmart stores. There is no language in our contract which requires or stipulates the repayment of this amount if the product was not accepted by Walmart's buyer. Furthermore, placement with a retailer is never gauranteed, and no such gaurantees were made in this case.
The claim of concern over return of product samples: again, it is at the retailers discretion whether or not product samples are returned. Walmart, as anyone who has ever worked with this retailer knows, never promises return of samples, it is at their discretion. In this case, the buyer did not offer to return the samples. There is no stipulation in contract that promised return of samples.
Claim of owed money is not backed up by contract exeucted between the two parties.
