my phone rang around 10 am morning on October i normally don't answer the phone but i was waiting for a call from my doctors office so i answered it. the voice on the other line had ask to speak to byron i informed the man on the other end that this is byron. He said sir i am calling in regards to an outstanding loan that you have with beneficial you do plan on taking care of this loan right. At that very moment i was confused and concerned because i have never taken out a loan with beneficial. He said sir i am looking at the loan right now with your name on it. It was then that it dawn on me that my girlfriend had taken out a loan in 2004 with beneficial but i never applied nor signed a loan with beneficial. I do recall driving with my girlfriend to the loan office so she can signed the agreement and pick up a check while i waited in the car she then appeared back to the car and said that they were having problems issuing her the check because her current driver license had her old address on it and not ours. She then told me that they said if i have my driver license on me with that address that i can sign this one document and they can release the check.

Never once did i apply or give out my personal data along with my social security number to beneficial. Currently they had me down as a borrow how could that me i never gave them authorization to do a background and credit check on me. I never thought twice about the fact that i was being mislead by this loan office being that my girlfriend had excellent credit history. A matter of fact they even had the address wrong on the loan agreement. The man on the other end of the phone starting informing me that i am reasonable for this loan and that my credit is in jeopardise. Immediately i started to panic because i have excellent credit history and never made a payment late in my life. So i decided to see what i can do to take care of this loan.

So after hours on the phone and trying to negotiate a paid off we came to an unreasonable amount. The collection agency then said the only way they can grant this amount is if i take care of it at that very moment i told him i didn't have that amount right now that it will take several days for me to withdrawal it from an investment account. He said well you can use a credit card. I said i don't have that amount on a credit card. He then informed me that i have to put at least 2000.00 down today or the deal is off. SO stupid me aloud him to take 2000.00 from my credit card and agreed to pay the remaining debt within 10 days. I then ask them to send me a receipt via mail or fax which i was informed that they will absolutely send me a receipt. I then requested that they send me something in writing to confirm this agreement he said he would once this loan in settled and paid in full. several days later when the funds were available in my account i call them to see where i should my my payment he then said he can take it right over the phone again i asked if he is going to send me a receipt with showing this loan is paid in full and settled he said he will fax it right over. It wasn't until later that evening when i was going though my mail that i notice that i was mail a payoff agreement that was less then want i was told over the phone. When i contacted the collection agency back to tell them about the letter the sent me and i should be entitled to the payoff amount in the letter they said that cant grant it because i settled for the amount i paid and the have it recorded. To this day i have yet to receive anything in writing from this company in regards to my settlement. I do no the laws and my rights and they have to send me document within 3 business days. I have ever intention on pursuing a legal action against this company.

If there is anyone else that was mislead and frauded from this company please contact me because i would like to see a class action suit against them.

Be aware that PBC will VIOLATE your statue of limitations by sending in money to your account on your behalf ... if you make a payment, it will reset your statue of limitations on your account, and PBC is a dirty company that will send in a payment on your behalf to reset the statue of limitations so you're still liable. they also violate the hell out of the fdcpa, the manager Christopher Velasquez and Eric Brechbill had me personally violate FDCPA at least 3 times a day, and if you didn't violate, you were terminated for gross misconduct or something along those lines. This is a terrible company in every aspect, SUE SUE SUE!

A few thing.

1. I agree with one of the previous responses, ... read it before you sign it. 90% of people don't look at a contract when they sign it, which is why they get in so much trouble.

2. Call PBC, ask them for your letter. PBC did not generate this debt for you, you did that. They are just a 3rd party agency that was hired to collect it. If you paid it, they will give you a paid in full letter at any point in time, you just need to request it.

3. You may have gotten a settlement letter in the mail ... but you paid the debt before you got the letter, so that is just a missed opportunity. But on the other hand, if you are in the interest of protecting your credit, then you would have wanted to pay the debt in full anyway.

So this isn't a situation where you got scammed. You just think you got scammed because you don't know any better. Call PBC, 18002709685, give them your social, and request a letter be re-faxed. Request it every day until you get it. Sometimes management is slow.

Life rules:
Don't sign ANYTHING until you read it.
Don't sign any documents or co-sign any loans for boyfriends/girlfriends.

By making a payment on this debt, you have validated it as legitimate and as your own. My first thought would for you to do a charge-back, but then this might make problems worse for you.

For your future reference so you won't be burned again:


Understand that you have rights under the Fair Debt Collection Act, which is a federal law governing the behavior of collection agents. Collection agents cannot take your firstborn child, nor can they send the sheriff to your residence to have you arrested if you don't pay them by sundown.

***Per the Fair Debt Collection Act you have the right to demand that ANY alleged debt be validated. YOU HAVE THIS RIGHT UNDER FEDERAL LAW SO ALWAYS INSIST UPON IT. If a bill collector calls you, YOU SHOULD FIRST ALWAYS tell them:

"I am requesting that this alleged debt be validated per the Fair Debt Collection Act."

Per federal law they MUST do this.... Even if you recognize that the debt that they are trying to collect on is real and valid, you should STILL request validation. This will give you 30 days to collect your thoughts and get a game plan in place.

Get their address and mail a follow-up written request for validation. Mail it via Registered Mail with Return Receipt
