 My husband & I have a HUD mortgage loan through Regency Finance- We as most people do wait until the last day (grace period) to pay our bills. Our credit report with Regancy is perfect-

If we are one day late with the company we receive threatening & harrassing phone calls particuarly from Mr Robert Hunter  & a woman names Jessica  on a daily basis. We have informed Mr Hunter as to how we pay our bills ( again Not Late). He has stated to us that this is unacceptable  & that he was "disappointed" in us.  I made it very clear to Mr Hunter last week via phone call (that I answered- he states we never answer phone) to No longer contact myself or my husband via phone - to send us mail.

On 9/1/13 Mr. Hunter sent us a letter stating that we needed to seek HUD Homeowner Counseling - stating that We are in default, or anticipate being in default on a home mortange loan secured by our principal residences: And Our Default has been or will be caused by the involuntary loss of, or reduction in our employment income or that of someone who contributes to our income.

Again I want to stress that we are not delinquent in our loan with them. This is pure harrassment & is borderline threatening to us .

First of all you posted on a PUBLIC web site, where believe it or not you are going to get people to post that you may not agree with.  However, if you would actually take your fingers out of your ears and stop saying "La..la..la..la..la..I can't hear you" you would realize that you are actually getting some good advise.  Oh and sorry but I do not work for this or any other bank..but when someone pulls out the "You must work for them" card..it really just shows you have nothing to deny what was said.

So let's keep this short as possible and to the point.

You received a letter stating in part... "or anticipate being in default on a home mortange loan secured by our principal residences". In other words IF you are not currently in defult your actions indicate there is a high probability that you will be in the near future. 

What are your actions..well

Paying close to or at the end of your Grace Period - Once or twice is not really an issue.  But if you make this a monthly habbit history and statistics show that it is only a matter of time that you start to slip past this date.

Credit History - You make a point that your history with them is fine.  But you never denied that the rest of your credit may be less than perfect.  Again if you have defaults or late payments with other creditors, history and statstics show that it is a higher likelyhood of you defaulting on your home loan.

The bankers are not harrassing you..quite frankly they would much rather you pay on your Mortgage than for them to have to go through a foreclosure and try to sell your house.   But they are also not empty threats.  Your mortgage is secured by your house, and if you fail to make your payments they do have the legal right to go through with a foreclosure.

So I will challenge you(but don't expect you to actually take me up on it).  Take them up on their suggestion to seek HUD Counseling.  If you go to them, give them your entire situation, and they say that you are just fine and have nothing to worry about.  You can have the honor of knowing you were right.  But if they tell you the exact same thing that was said here..perhaps you will FINALLY start to listen to them and realize that they are there to help not harrass.

 Lol! I'm sorry, Jim , Robert or whatever your name is ( like we care)! I have 4 words for you! Mind Your own business!!!! We do not care what you or anyone else thinks about our situation!Last post! We said what we had to say & are sick & tired of wasting our time this afternoon arguing with losers . The Better Business Bureau will handle this for us. Go " harass" someone else! Lol!!!! So long losers!

Why don't you offer a mature, intelligent, point-by-point rebuttal of Robert's posting???  Instead, its the same old immature, stupid nonsense of "you must work for them"!  The reason you won't offer said point-by-point rebuttal is YOU DON'T HAVE ONE!  Robert hit all the nails directly and very squarely on the head, didn't he?  Since that what he very obviously did, you have three choices:  you can write back and tell him "thank you" for enlightening you; you can not write back at all but take away the lessons he taught you...or...you can act like an immature little baby boy, stomp your feet, make your insults and then its the old dodge of "who do you think you are...you must work for them!"  Two words, my friend...read those two words very, very closely, here they are:  GROW UP.

Hmmmmmmmm Robert this must be you???? I'm sorry but when did you actually become a "real banker"? Like Never!! You are a "branch manager " with a " finance company"! Yes you & your staff members are & have harassed us repeatedly!!! We are also Not & I do repeat again Not late on our payments ! How hard is that to understand??? Especially hard for Morons!!! We are not late past the grace period & yes most people in America do wait until that time to pay. We are all not made of money like apparently you are!! Also if this is not Robert mind your own business!!!!

You are playing with semantics to try and justify your actions.

First of all your mortgage has a due date, the first of the month.  If you pay it after the 1st it is LATE.   Now, yes it is true that you have a Grace Period, but that is just a grace period before they assess any additional late payment fees.  It does not take away from the fact that you are indeed late.

In the end bankers have better things to do than to "harrass" people who are current on their Mortgage.  So there is definatly more to this story than you are saying.  One has to wonder with your word play, is the "one day late" actually 1 day past the due date or 1 day past the final grace period date? 

The reason you got the letter is because history shows that once people start paying close to or at the grace period date..the risk of them defaulting increases greatly.  One also has to wonder how you specifically say your credit with THEM is perfect.  So what about the rest of the creditors?   Again that can go a long way to explaing how you MAY default in the near future.

 

Oh and contrary to what you think..MOST people do not pay their mortgage on the last day of the grace period.

 First of all.... We pay our bills before the grace period is up! Apparently you didn't read where I said that our credit rating with them is Perfect. This does not warrant receiving phone calls telling us how disappointed they are of threaten to have our checks garnished. Ridiculous statements from you!!

First you say you are never late.  Then you say you are late!  Anytime the borrower is late, that borrower (YOU) turns on the collections machine.  One day past the due date is "LATE".  Don't want to get the collections calls?  Easy solution.  Don't tell them to call you by PAYING LATE!!!
