Sam Packs Ford Country of Lewisville and its owner, Sam Pack, violated the Texas Deceptive Trade Practices Act and committed fraud in April of 2011.  Sam Packs dealership certified my 2008 Ford Fusion (V.I.N. # XXXXXXXXXXX222876) with known frame and collision damage as a Ford Certified Pre-Owned vehicle, and sold this Fusion to an individual in Highland Village, Texas on April 7, 2011, and failed to disclose the Fusion had been involved in a collision.

Xxxxxx,

A few months ago you indicated you would soon be in the market for a vehicle and asked me for a

dealer referral.  Our neighbor Dave was present at the time you asked for the referral.  Dave and I both previously purchased vehicles from Sam Packs Ford Country of Lewisville, and at that time I highly recommended this dealership for your next vehicle purchase.

Unfortunately, I later discovered Sam Packs Ford Country of Lewisville fraudulently certified my 2008

Fusion as a Certified Pre-Owned vehicle and fraudulently sold it to an individual living in Highland Village, Texas, under the pretense it had never been wrecked.  Part of this fraudulent information was discovered in documents subpoenaed from Sam Packs Ford Country of Lewisville by opposing counsel during a diminished value suit I brought against the person who caused the original damage to the Fusion.  Additionally, I made contact with the individual who purchased the Fusion from Sam Packs dealership and he advised the collision and frame damage was not disclosed to him at the time he purchased the vehicle.  This fraudulent information subpoenaed from Sam Packs Ford Country of Lewisville caused me to lose my diminished value suit on February 5, 2013.

I brought this information to the attention of Mr. Sam Pack, owner of Sam Packs Ford Country of

Lewisville by certified mail / return receipt at his business office located at 2070 Diplomat Drive, Farmers Branch, Texas 75234.  Mr. Pack contacted me by telephone on Tuesday, March 5, 2013 and during the conversation Mr. Pack stated his dealership intentionally certified the Fusion as a Ford Certified Pre-Owned vehicle.  I informed Mr. Pack, per Ford Motor Company Customer Relations, Any frame damage will not allow a vehicle to pass a Ford Certified Pre-Owned vehicle inspection"

Additionally, when I traded the Fusion at his dealership, I stated the vehicle had frame and collision damage.  I received $3,850.00 less than average trade value for the Fusion based only on this lawful disclosure.   Mr. Pack stated he had reviewed dealership records since the sale of the Fusion and said, since the new owner of the vehicle has not complained, the deal stands, and he intends to do nothing about it.  It appears Mr. Pack, and his dealership is playing both ends against the middle on some of his used vehicle sales. 

Mr. Pack and his dealership penalized me $3,850.00 at the time of my trade for complying with the law and disclosing the frame and collision damage.  Mr. Pack and his dealership then committed fraud by certifying the Fusion as Pre-Owned (with known frame damage) and failing to disclose the frame and collision damage to the individual who purchased the Fusion from his dealership, thus collecting a higher margin of profit from this sales transaction (although its illegal).

I received a certified letter from Mr. Packs attorney the other day.  Mr. Packs attorney denies his client has caused me any harm.  Interestingly, the letter does not refute the facts Mr. Pack and his dealership have committed fraud and violated the Texas Deceptive Practices Act.

I strongly disagree with Mr. Pack and his attorney and have filed a lawsuit to recover my damages.  I have also filed a complaint with the Texas State Attorney Generals Office, the Federal Trade Commission, and Ford Motor Company. 

Regrettably, I have referred many people to this dealership.  I will be making every attempt to contact everyone I referred to Sam Packs Ford Country of Lewisville to alert them of the unethical and criminal activity associated with Mr. Pack and his dealership. 

I rescind any referral or recommendation I have ever made to purchase a vehicle or conduct any business with Sam Packs Ford Country of Lewisville, or any other dealership owned or controlled by Sam Pack.
