Santander has very poor customer service. First, they offered to give me a modification of the loan. Then when I spoke to manager, they offered a special modification due to medical and financial reasons. I have paid 22 payments of 560.00 of kia sorento. My balance is still 26,000. I need to know if anybody is in this situation and want to help millions of us. Please respond if you have a lawyer representing you against this company. Also, they call me 10 times a day, harassing me that they are taking my vehicle. This is the only one I have , I will not be able to work if they take it. I do not think it is very fair that they are not willing to work anything out. They rather loose money and take vehicle, which is only worth 10,000. Bad company, they take advantage of bad credit and rip them off.

Where in your loan agreement does it say that they must "modify" your loan?
Where in your loan agreement does it say they can't repossess your car if it is your only one?
I'll give you a hint..it doesn't. You made a legal agreement to make a set payment at a certain time EVERY month. You can spend money on a lawyer all you want but they will tell you the same thing.
Bad company, they take advantage of bad credit and rip them off.
- That may very well be, but the fact is YOU let them do it. They may offer you a car at certain prices but in the end it is YOUR choice whether to accept the deal or not. While of course I don't know why you have bad credit, based on your report it seems as if your lack of judgment is a big part of the reason.
After all where in your mind did it seem like a good idea to pay over $26,000 and pay $560 a month at a very high interest rate? Do you realize if you had just saved that amount for 4-5 months you could have paid for a car outright. Would it have been a great car..no but it would have been paid for.
