Saxon has returned mortgage checks if check is not for the amount they say you owe.
I am disabled and get to pay our property taxes the year AFTER they are due every other month. Saxon sent me two letters claiming that we were delinquent in our 06 taxes, I paid these two amounts the following month when they were due and faxed Saxon the paid receipts. In Dec of 07 Saxon, still claiming that we were delinquent, paid our 07 city and county taxes along with an 06 amount to the county that was refunded back to Saxon two months later because we were not delinquent. When the city returned my Jan. check telling me that ALL 07 taxes had been paid in Dec. by Saxon was the first notification that I had that Saxon had paid the taxes. I called Saxon's tax dept. and asked what they were doing. There was NO escrow account on our loan. Their reply was that we had been delinquent with our 06 taxes and that gave them the right to pay all future taxes. I told this stupid little lady that as a disabled person Saxon had taken away my right to pay my taxes in the year after they were due every other month. I once again faxed Saxon all my 06 and 07 tax bills and the receipts where I had indeed paid them. I refused to pay Saxon any escrow monies because they were NOT within their right to establish an escrow account. I paid them principal and interest only. They took my $1200. and applied it to their escrow amount, drive-by fees, attorney breach letters, late fees and foreclosure/attorney fees (which I never received). I called HUD and told them what Saxon had done. I was told that Saxon was obligated to rewrite the loan since they had changed the original loan documentation by adding an escrow account to the loan. I started contacting Saxon's loss mitigation dept. in May and it wasn't until the end of July 08 that I finally got someone that actually sent me the paperwork. I was also told that I was NOT to pay Saxon any more payments until the loan modification was complete.
In June of 08 I filed a disabled tax deferral with the city and county. I faxed Saxon's tax dept. a copy of this explaining that this affidavit meant that I no longer had to pay any more property taxes. This would stay in effect until both my husband and I died or we sold the property.
On 8/11/08 I received Saxon's loan modification package. They wanted everything returned within 5 days. I filled out all their paperwork and faxed this and all their required documentation back to them on 8/13/08 (2 days). August turned into Sept. and on 9/17/08 Saxon sent me a letter advising me that I had failed to make my monthly mortgage payments and they were going to initiate foreclosure proceedings. I promptly called their loss mitigation dept. and asked what in the world was going on. Did they not get my faxed modification paperwork? Yes, they had received it, but the negotiator that they had assigned did nothing so they had to reassign it to someone else. She gave me this negotiator's name and extension and transferred me. I got her voice mail and left a very detailed message. She never returned my call. On 9/29/08 I again called Saxon and was told that my modification had been approved. I was given the details: same interest rate for 5 years but yet my payment had gone up by $6, they tacked on escrow which raised it by another $83 and the paperwork would be sent. Sept. turned into Oct. and then Nov. and Dec. Still no paperwork arrived and this female negotiator NEVER returned any of my phone calls ( I called monthly).
On 1/9/08 my son's friend gave me a FedEx package that he had found on our front porch (We don't use our front door so I had no idea that a package had been delivered the day before). Had they sent it and paid extra for a required signature I would have known that on 1/8/09 a package had arrived. The interest rate was the same and they had tacked on $9,112. in delinquent interest. Our new payment was no longer $1202 but $1268, which did not include escrow. I was also being made responsible for all their attorney fees and I had to send an "initial contribution" of $2941. in certified funds in 5 days when the money and the signed paperwork was due back to Saxon. I once again called the negotiator and once again I got her voice mail. I left a very detailed message which came down to, "We are not signing these papers because your terms and you're wanting money to modify a loan are unacceptable." She did not return my call so 3 days before the paperwork and money was due back to Saxon I composed a letter to this so-called negotiator and faxed it to her.
On 1/27/09 I filed a complaint with the Texas Dept. of Savings & Mortgage Lending against Saxon. My complaint was acknowledged on 2/3/09 and Saxon had until 2/17/09 to answer all my charges.
On 1/31/09 I received an interest statement from Saxon. Also on this form was a taxes paid amount. Saxon had, once again, paid our 08 taxes. On 2/2/09 I called my county and city tax bureaus. They gave me the amounts that Saxon had paid them in Dec. Saxon had under reported how much they had actually paid by $600. I then called Saxon's tax dept. and asked this female, that was unfortunate in answering my phone call, why Saxon had paid our 08 taxes when I had a tax deferral affidavit on file with them. Silence. She had no idea how or why the 08 taxes had been paid. She would put in a request to the taxing authorities to have their tax money refunded. I then asked her why Saxon had under reported the amount of taxes they had actually paid. She told me that it was a customer service error and I needed to speak with them. I called customer service and was told that the tax amount was done by the tax dept. and I needed to speak with them.
Saxon sent a letter in Feb. telling us that our loan modification had not been approved because we failed to submit the signed paperwork and the monetary contribution. We also got an escrow statement for 2009 telling us that we still owed Saxon $953. in taxes and we had to pay $79. a month extra On 2/23/09 Saxon had this female they call a community outreach research specialist answer my charges in my complaint. She says that we owe Saxon $3762. in taxes (08 taxes were included) and $15,072. for June 08 through February 09 principal, interest and escrow. We also owed them one uncollected late charge, property inspection fees, attorney breach fees and foreclosure/attorney fees (which I had never received). She included 6 pages of our account history which included 11 breach fees ( I never received 11 attorney letters), 21 property inspection fees (that's where they drive by to make sure you are still there) and 6 expense and corp. advances ( I have no idea what these are for).
We can NOT work with a mortgage company that will not work with us. Saxon has violated my rights as a disabled person. They tell you not to send monthly payments until the modification paperwork is approved. Then you get a letter telling you that they are going to foreclose on your home because you didn't pay them. One cannot pay Saxon on line or mail a check unless you pay them that THEY say you owe them. They are constantly sending letters where you are asked to contact them. One calls them and you are told that the letters were a mistake and to disregard them; the letter was a mistake. They cannot and will not explain their amounts due because the amounts are constantly changing. They loose what you fax them and then deny that you ever sent it.
