ATTENTION MASS SOVEREIGN BANK EMPLOYEES!!
My girlfriend works for a branch office. She is paid on a bi-weekly basis.
When overtime in ONE week is worked, the employees are required to NOT claim the hours for that week and to take "comp time" the following week(or later). This clearly violates M.G.L. c.151, s1A.
Sure it's only an hour or two here and there, but consider how much Sovereign POCKETS over the hundreds of MA employees. (bonuses for regional managers for saving money??)
Rise up Sovereign employees. I'm sure you, like her, are afraid of saying anything and losing your job(which would be illegal too in MA).
Don't shave your timesheet to save their spreadsheet. It is also illegal for you to agree to suppress the reporting of overtime. THEY HAVE TO PAY YOU OVERTIME WHETHER THEY LIKE IT OR NOT!!! Overtime is based on a forty-hour workweek NOT an 80 hour pay period.
From everything I've heard from her, YOU GUYS SHOULD UNIONIZE!!! think about it....put THEM in THEIR place for a change.

She's worked in a few different branches, and it's always the same. she's made to take compensating time, not money, for the overtime.
This has nothing to do with working Saturdays per se, it has everything to do with OVERTIME.

The first sentence on the statute you quoted is as follows:
'Except as otherwise provided in this section, no employer in the commonwealth shall employ any of his employees in an occupation, as defined in section two, for a work week longer than forty hours, unless such employee receives compensation for his employment in excess of forty hours at a rate not less than one and one half times the regular rate at which he is employed.'
Like I said, maybe I am missing the point, but it does state that Sovereign (employer in the commonwealth) won't employ anyone longer than 40 hours unless they of course receive time and a half.

I work for the bank, however not in a branch position. If I work a Saturday I get paid overtime, clear and simple. I would advise your girlfriend if she doesn't like the idea of comp time to apply for a back office position. It's more fun, you get paid more money AND you get paid overtime if you're scheduled to work on a Saturday.
By the way, I did at one time work in a branch and would have rather received overtime pay instead of an afternoon and morning off!
