Interested in looking into a class action lawsuit.

On May 2, 2009 we purchased a Motorola i776 phone from the Sprint store located at 713 Good Homes Road, Orlando, Florida 32818. The phone was purchased on their Boost National Unlimited calling plan for $50 a month. The phone has problems sending & receiving calls and text messages.

We spoke to the manager, Richard Palmagary, and the bottom line was we were told that Sprint had no connection to Boost, that they would not accept the phone back for a refund or exchange and we should deal with Boost or Motorola.

We explained to him that our daughter was there for college, that there was no landline phone in the house for her to use to dial 911 if there was an emergency, that we could not count on the phone working and that we have had the phone for less than a week.

He said that Sprint would not help, that Sprint had no connection other than to sell the phones.

We found two similar complaints on ripoffreports #436156 problem with the Motorola i776 and #432905 similar problems with the Motorola I9.

Is there a connection between Sprint Nextel & Boost?????

First of all let's consider the fact that Sprint sold us the phone and charged us $50.00 cash to activate it.

Think Sprint is making any money from selling these phones!!!! I guess the money connection is not supposed to count according to Sprint.

Sprint has been made aware of this problem and is refusing to do anything about it while they profit!!!

According to their last 10-K filed for the year ending 12-31-08, we found the following relating to Boost.

http://www.sec.gov/Archives/edgar/data/101830/000119312509040575/d10k.htm

In the 10-K under:

*** Valuation and Recoverability of Goodwill and Indefinite Lived Intangible Assets:

It states:

Intangible assets with indefinite useful lives represented $19.3 billion of our $58.3 billion in total assets as of December 31, 2008. We have identified FCC licenses and our Sprint and Boost Mobile trademarks as indefinite lived intangible assets.....

Ok, So the Boost name, along with Sprint, is worth about 19.3 BILLION dollars. Yes billion not millions. Any connection yet between Sprint and Boost????

It also appears that the "Boost Mobile" name is trademarked by Sprint Nextel. Well does anyone see a connection yet to the Boost Mobile phones that Sprint sells yet Hmmmmm?

We also found in this 10-K that Boost Worldwide, Inc is a subsidiary listed in the 10-K, along with the Boost name registered in several states. Any connection yet maybe????

This is so sad.

***Now we don't need to wonder why we also found also in the 10-K:

Our recent efforts to attract new subscribers and reduce churn have not been as successful as those of our competitors. Our subscriber losses and high rate of churn have impaired our ability to maintain the level of revenues generated in prior periods and caused deterioration in the operating margins of our wireless operations and our operations as a whole

If they are looking at ripping people off to help with their revenues they should try and understand that we the people will never ever use them after doing this to us. So they may get to keep my $100.00 for the phone and my $50.00 activation fee but they will never get another penny from us and everyone we know will know about our problem. To say the least I see that Goodwill value dropping already!!!

Did I fail to mention that if you run the SPRINT name in ripoffreport it comes back with one thousand three hundred hits.

We have activated another phone for our daughter to use, and now will begin the long journey of trying to get our money for the phone activation refunded, etc.

If you are having the same problems with your phone please e-mail us. We can be reached at

Good luck
