I have a smith and nephew knee joint. It has given me nothing but pain. I found out this joint has been recalled. When I ask my doctor if it were possible that's why I hurt all the time, he said he did not use their medical devices.

I contacted hill and boren in Feburary. They said I definitely had a lawsuit against smith and nephew as well as the doctor for putting in a recalled joint. I never heard anything from hill and boren so the first week of may I called, my call was not returned.

So after three days I called back. The legal secetary didn't know anything about my case. When she finally got my file, nothing had been done; no medical information had been gathered, no papers had been filed. Nothing the lawyer, Jeff Boyd said would be done, had been done.

On may 31st he called me to inform me that he couldn't prove my case, not that I didn't have one just that he couldn't prove malpractice or defective joints. This was my third surgery on my left knee. All the joints, bone cements, were made by smith and nephew. The bone cement used in the first surgery was recalled three months prior to my surgery.

I am not the only patient that went to hill and boren because of this doctor. Jeff Boyd said they had filed suits against this same doctor when he had a pratice in memphis, tn.

They did what you hired them for

I don't really understand your complaint. Jewell, but it seeme that the attorneys reviewed your case and decided that it wasn't merited.

If a lawyer deicdes, from an initial consultation, that he will not be taking you on as a client, then he has anethical obligation to let you knwo how long you have to file your claim. This is so you can find an attorney that will take you as a client.

If, on the other hand, a lawyer looks into your case so deeply that he consults an expert, as this form seems to have done, and then advises you that you don't have a case, I don't think the same obligation exists.

Would a doctor ever say something to the effect of "My tests show that you don't have lung cancer, but, if I'm wrong, you have two weeks to get a second opinion"?

When you initially consult with an attorney, you are seeking advice, not a lawsuit. Unless you have a clear cut, unquestionable claim (which you don't), then you need to understand that you will be getting advice intially, and maybe a lawsuit later.

If you go to a lawyer with a possible lawsuit, and he ends up telling you that you have no case, the lawyer is under no duty to tell you how long you have to seek a second opinion. Or at least I think that would be the case.

It does seem to me, however, that these guys could have moved a little more quicker on your case, and done a better job of keeping you updated.

hill and boren ripoff when the lawyer does'nt tell the client that it's date of discovery

It is a ripoff when the lawyer does'nt tell the client that it's date of discovery,not date of surgery.after all,why would you let a doctor put a recalled joint in your body?Why I feel ripped off is that the lawyer called me and said I had four days to take legal action, that no other doctor would go against his colleage.

In Tennessee there are no laws todate to protect paitents. A doctor does not have to disclose imformation about recalled products.Hill and boren did not send me my other knee joint back,as I requested,I even told tell to send it c.o.d..I have gone out of stste to try to find a lawyer,but it takes time to gather all the medical imformation,again.

How is this a ripoff? you just need to find a different attorney.

They didn't take your case because they felt the evidence wasn't strong enough. That's not a ripoff, you just need to find a different attorney.
