It has been a few months since I posted my rebuttal in the hope that it would prompt some response from the author as they would have been advised of the rebuttal (provided the e-mail they gave with the report was genuine), unfortunately nothing has transpired. Some things I don’t understand about the report; if I had a genuine grievance I would want my name published not remain anonymous. Also as claimed that a theft had taken place why no legal action has been taken and why no evidence provided with the report? In all probability the author fears legal action.

The first amendment in the US would appear to protects the identity of the author and short of paying $2,000 for arbitration or taking legal action in the US  to have the identity of the author revealed (I am not a US citizen nor do I reside in the US, a subpoena to obtain the identity is required to be served personally) it would appear anyone can say anything they want about any individual not matter how erroneous the report may be and without any supporting evidence, surely some evidentiary support should be provided with any report for it to be accepted and published?

I am appealing to whoever posted this report to reply to my rebuttal.

This report has been brought to my attention. I am concerned that this report could be published without any evidence or corroborating facts being presented.

David Jacka resigned from Boracay Transpacific Properties Inc (BTPP) in 2009 (4 years prior to this report being published) due to differences between him and the then board of directors, shareholders and associates of BTPP. Unfortunately the person filing the report has not identified themselves so it is difficult to answer them specifically but the report is ill informed and misrepresented.

Trans Pacific UK was a totally separate company from BTPP, David Jacka was never a director, employee or shareholder of the UK Company or involved in any investments, mining, mineral or food businesses under the UK Company.

Trans Pacific UK was the sales agent for BTPP and Seven Continent Investments were the sole UK agents for the sale of the development in Boracay. Contrary to the statement presented from HR Recovery, the liquidator for 7CI, 7CI went into liquidation holding funds that had been collected from clients on behalf of BTPP. 7CI were withholding clients signed contracts together with the funds they collected that were never transmitted to BTPP.

The images used in this report are a misrepresentation; the images are not of the development in Boracay. There was no multi storey building in front of the beach and no collapsed building. Also Boracay is not in the USA!

I am aware there was grave discontent and losses for investors which I foresaw coming and prompted my resignation as projects were being overstretched. I am in no way mitigating the loss of any investor’s funds, but the facts need to be made clear.

To state that David Jacka is a liar and stole this person money is pure libel. David Jacka is not the owner of the corporation or the development. Any funds sent direct to the corporation’s bank account in the Philippines would have been received by the corporation. No funds were ever transferred to David Jacka directly. I request that David Jacka’s name be removed from this libellous report before taking further action, the finger is being pointed in the wrong direction.
