While I was overseas in Europe, Triad (aka Roadloans.com) came to my house and repossessed the car at around 3am, according to my parents. As stated before, I was given no notice of a missing payment at all via paper, email or phone. I've heard that it's illegal for them to repossess without contacting the client multiple times. Also, it may be illegal for the impound/towing company to take the car outside fo normal business hours.
They moved the car from one impound to another and then another, which accrued fees. I wonder if that is illegal as well.

On top of that, the impound company took all my possesions from inside the car and eventually charged a handling fee plus rental fee/day for holding personal property.

While in Europe,I had to find a U.S. Consulate General to notarize a Power of Attorney so that my parents could handle the matter as much as possible in my absence from the U.S.I also had to DHL the letter for next day service. The whole process cost me over $100USD and was horrifically distressing.

Upon returning to the states, I find that the jerks who repossessed the car broke the latch to the glove compartment and so now I must pay fees to fix that as well. Triad claims no responsibility for property taken a/o damaged but all this would have never happened were it not for them.

Repo guys work as contract agents for lenders. If you actually read the repo order, the order informs the repo guy the lender holds harmless them failing to pick the vehicle up, but, it also says they are held harmless if the repo guy violates any laws. Its a legal net to protect them (lender).

If you are getting a vehicle repo'd and you know it (its happening at that point), call the police and tell them you have a trespasser and you feel threatened. When the cops arrive with lights and sirens and meet the repo guy, then they tell you "Formally" who the guy is, tell the cops repossession is a civil matter, and the guy has no court order to remove the property from your property.

A light bulb will go off in the cops head and tell the guy to leave your property and not return. If the cop is a community policing type cop, he may even offer you the opportunity to file charges for trespassing and arrest the guy for you.

Public ways are totally different. Anything in a public way is free game for a repo guy. If your in the park with your kids and the tow truck arrives, the cops will stand by while they take it.

But, getting back to my first paragraph, you would have no case against the lender for repo mans conduct. You would have to show a relationship outside the scope of the repo order, which would be difficult.

When in doubt, always seek legal advice - before - it happens (or may happen).
