Chief of Police

Tustin Police Department                                                                                 Friday April 08 2011

Official Complaint -
Officer Garzone #1193

CC:
Officer Garzone #1193

Legal Department  for Legal Action

Public Relations Officer Tustin police Department

Dear Chief of Police,

This letter regarding unfair Treatment and utter altered importance by one of your officers (Officer Garzone badge number #1193). I expect an apology and an immediate rectification of this situation. If this does not occur I may pursue
legal action.  I received a ticket for $253.00 This is what happened:

This evening it was pouring rain, Friday April 8th at 9 PM. My wife returned from buying groceries at the store. My wife found no parking nearby on the street and had to park on the lawn in order to avoid walking two blocks in the pouring rain. Note: This is my father in laws residence and private property, the property of his landlord and rented by him our property.

Anyhow, my wife parked the car, mostly on our lawn and partially our driveway close to the door. She came in and asked me to help move the car. I was working and proceeded to finish what I was doing.

When I went outside to move the car, I saw a Tustin Police SUV blocking our driveway.
NOTE: It was still raining.  I got the items out of the car and was worried that something was wrong, I went to talk to him. He said that it was illegal to park on the grass in Tustin (which I can understand junky cars parked on lawns are unsightly). However my wife drives a 2009 Prius a nice car and just parked on our property in the rain. I told
him my wife just parked there because it was pouring rain, to bring the groceries in and could I just let me move the car and let me off.  He said no.  I also tried to move the car and he blocked the driveway for two minutes until he gave me the ticket and finally moved.

This is NOT what we pay taxes for. It is a complete altered importance by your officer and the police department in general. The police department is there to protect and to serve. NOT to fine and unjustly give tickets and violate our
constitutional rights.

Additionally Mitchell Avenue (1100 block between Red Hill and Browning) is literally impossible -  half painted red for no visible reason (other than making it difficult to park for residents thus more tickets). The entire south side of the street is District stickers only.
We have attempted to get District Stickers, but because we are on the north side of the street we cant get them. I have been here one month and have received over 5 tickets. Due to no District 21 sticker, street cleaning at 7am, blocking
driveways, etc.

I appreciate you keeping the area safe. This violates our rights and is unfair treatment of civilians.

Ummm...don't you have the right to fight your ticket in court?  I would bet that any response to your "letter" will remind you of this fact.

Anyhow, my wife parked the car, mostly on our lawn and partially our driveway close to the door. She came in and asked me to help move the car. I was working and proceeded to finish what I was doing.

Taking a shot in the dark here.  There was quite a time lapse between the time your wife came in and you finished what you were doing.  Where you were no longer "unloading" but "parked".  Perhaps next time when your wife asks you to go move the car...you may want to do it right away.

He said that it was illegal to park on the grass in Tustin (which I can understand junky cars parked on lawns are unsightly). However my wife drives a 2009 Prius a nice car and just parked on our property in the rain.
- So you are special and should be treated differently because you own a 2009 Prius?
