Wensmann Homes Our son was forced to work under dangerous winter winds, he got killed. The company did not have current emergancy info for their employees. I was not notified for 8 hours of his dealth, because of sloppy office record keeping. Also this company does not have drug testing. My son was under the infuence of THC. This company has to be accountable Eagan, Prior Lake, Woodbury, Apple Valley Minnesota

Actually THC stays in the body for several days after smoking so your son may not have been high. Personally I think drug testing without cause is a violation of privacy rights and I , for one, am not willing to sacrifice my rights because of the silly 'war on drugs.'

Your son chose to take the THC.
It tends to mess up your perception a bit.
If they found it in his blood ( and they DO a toxicology test at an autopsy if someone dies in an accident like your son did( and they found evidence of THC in his blood stream or in his hair, ( THC- the active ingredient in marijuana and hashish that gives it its intoxicating qualities...)

It is not his employers' fault that your son chose to ingest THC and go to work on a rooftop.

You need to see an attorney in your state to see if you can file a wrongful death claim action but I can tell you right now, if they have proof he was high or under the influence of a drug at the time of his death, the worker's compensation insurance claim goes nowhere.

Maybe you can get a settlement out of his company but under these circumstances, where I am from, it looks very doubtful.

You need to consult with a licensed attorney who practices wrongful death law in your state.

The responders to the Wensmann employee are typical of Minnesota caliber thinking. BTW I do not mean MN nice - I mean MN Stupid.

Wensmann uses contractors for building their homes and any reputation by said contractors is also typical in a non-union environment where employers use unskilled laborers with no training or skills to save money for the owner. Using these contractors is the only thing that any reputable builder should be responsible for and I'm sure any lawyer worth their weight could bring a case to teh courts on that one. Statements like the one from the alleged South Carolinian is the most obsurd ever, so I'm sure that person is also from Minnesota. I had a nephew injured on a job site back in Illinois while working summers and as usual, the owner hired cheap kid labor and low-life contractors to to their buidling work. No training was offered for these school aged kids and this particular accident involved a saw blade severly gutting a major arterie and tendon in his leg and foot. I don't care if the recipient of the injured party may have been on drugs, tired or just unskilled. The contractor suggested he not claim the injury as a workmans comp injury to allegedly save his reputation when any idiot would know he just didnt want his insurance premiums raised. The injured reported the injury as a wrkman comp issue and the contractors insurance ended up paying $80K plus in medical surgeries. Thank God for some of the agencies that try to keep these contractors in check.

I love it when a contractors goes under due to their own unethical practices. Serves them right.

Now for you Minnesotans, I suggest you start thinking with your lawyers and not your own heads because th elatter does not appear to be working! We are not living in Norway folks - this is the U.S.A.

First and foremost I'm sorry for your loss. I wish the best for your family.
However I have some questions about your report. I do not now nor ever have worked for the company you reported on nor have I even heard of it before seeing your report. That being said:
#1 It is up to the individual to ensure ant emergency contact information is kept up to date. If there's a change of address or phone number, the company won't know until the worker tells them.
#2 Did you know of your son's marijuana use before this event? If so maybe some intervention would have been available to get him off pot? Did the drug have anything to do with the accident?
#3 I'm sure this incident has or is being investigated by state and federal agencies (OSHA, etc). Has anything been found against the company, if so there would be fines levied for safety rule violations.
#4 Every job is dangerous. Yes construction work is more dangerous that working at Walmart, but even an accident at Walmart can be fatal. It only takes a drop of 12 inches to break a spine or neck, so every one is at risk. but each company is responsible for following the appropriate safety guidelines for their type of employment.
