I signed up for zWallet in mid=September. After referring 2 people, questions were being asked about their account balances, page views, referral, etc. that I could not answer. I emailed support@zwallet.com, question@zwallet.com and admin@zwallet.com numerous times (at least 6 times) starting September 18th to get an answer.

As of this date, I have received no reply. At the beginning of October, I noticed that my account had not been credited properly, nor had my referrals. I clicked on the Account Balance button and a box popped up stating the account balance does not reflect September and October.

Also, at the beginning of November, I checked my account balance and see the same box pop up stating the account balance does ot reflect October and November. With all of the work that I have done, I have only been paid $1.50.

I am very dissappointed with zWallet. When the initial letter asking me to join was emailed to me, one of the phrase states "This is a job!" This is a company that I will no longer work with.

Unfortunately, I've wasted 2 1/2 months of my time and effort to work with zWallet.

Unfortunately zWallet has covered themselves well in their user agreement

AUTHOR: Melinda - ()

POSTED: Sunday, November 17, 2002

I did some hard serious reading on the zwallet website and have determined the following:

Nowhere on the website does zwallet make any claims to be anything other than an e-mail service provider. They do say you can be paid a percentage of the PAID advertising revenue and will be paid up to a certain number of page views and for those of your referrals, but this is vague at best. A few things for the consumer/employee to note before joining or complaining about zwallet:

1 - There is no way of knowing whether an advertisement was paid for (meaning the user gets credit for it) or not.
2 - Users are only paid for the first 10,000 page views so there's no way to manipulate it to where only 10,000 paid ad e-mails are opened
3 - Users earn 40% of the ad revenue of the paid ads - two things - 40% of what and 40% per user or divided by the total users? Unclear and zwallet does not elaborate or answer this question.
4 - Users don't know who are subsidiaries or partners of zwallet that would count as a free ad.

Their user agreement really covers their own legal rear end. States plainly that zwallet can change their policies and procedures at any time and will notify users on the website. They also state how users are paid (vague) and that they (zwallet) will notify users when they are "eligible for payment" - and their definition of "eligibility" is broad and vague:

"You will only be paid, when eligible, for paid Advertisement (those Advertisement that payment has been received for) placed on zWallet.com web pages while You are logged into Your account. You agree that advertising decisions are at the sole discretion of zWallet.com. zWallet.com has the right to place Advertisement, paid for or not paid for, on all zWallet.com web pages. Not paid for Advertisements are those that either payment has not been received for or were not sold for money. At any time, zWallet.com has the right to place Advertisement for zWallet.com, it subsidiaries, affiliates, and programs at no cost to zWallet.com. You agree that not paid for Advertisement result in No Advertising Revenue, and therefore no Payment will be issued to You. Payment only results for paid for Advertisement in which payment has been received."

Finally - the last clause of the user agreement basically states that zwallet is only obligated to provide users with the promised e-mail service - not a money making opportunity and no users are obligated refer anyone to zwallet nor is zwallet obligated to provide any additional services to users. They also state there is no employer/employee relationship thereby possibly negating any obligation of payment.

"By completing the registrations process and by clicking on the "Submit" button You are applying to receive a Service and/or Programs. Your relationship to zWallet.com is one of an independent contractor and/or customer. No employee-employer relationship is created by Your use of Service and/or Programs. You are not obligated to refer anyone to zWallet.com Service and/or Programs. ZWALLET.COM IS NOT OBLIGATED TO PROVIDE ANY SERVICE AND/OR PROGRAMS OR ANY OTHER PROMOTIONS TO YOU."

My opinion and advice for what it's worth:

1 - zwallet did a great legal CYA for themselves in the wording of their user agreement and other documents on their website. Their services are FREE so users can't claim fraud or attempt to fraud by taking of anything monetary or tangible.
2 - zwallet says POTENTIAL income on the calculator and since the variables aren't communicated, who knows the equations they're using. Frankly (in my opinion) that calculator represents stupidity not fraud - stupidity of zwallet to refer users to it while not explaining the variables of how it's calculated and stupidity of any user who actually believes he or she can make $12,000 a month for reading and deleting e-mails.
3 - Some users are angry that they were not paid according to what they were either promised through other user advertisements or potential income based on the calculator - neither of which represents a legal binding agreement or contract. There are some users actively recruiting using statements like "Make $12,000 a month deleting 30 e-mails" - THOSE are the people committing fraud with the promises of specific income. Look on the zwallet referral corner site again - no promises like this are made or implied.
4 - the payment schedule - now here's where zwallet could be considered shady - by delaying the payment, they're banking on people getting fed up and quitting. Their user agreement reads that one must be an active user to be deemed "eligible" for payment by whatever terms zwallet is using - again not clearly defined.

Finally - yes - their customer service is horrific - they never return e-mails or answer questions so that is reason for a complaint. But it's not a "rip off" as no promises were made to anyone and no money was solicited from users by zwallet. Any monetary expenditures by users were of their own doing.

Zwallet may prove to be a ridiculous venture but by legal standards, it's not a ripoff or a scam since they covered their own rear ends and interests in the user agreements and wording used. Any while many users feel "betrayed" by the implied potential earnings they felt were available by using zwallet's services, legally there's no case for fraud, and in section 3 of the user agreement, all users basically give up the opportunity to sue zwallet:

"3. Indemnity
You agree to indemnify and hold zWallet.com and its subsidiaries, affiliates, parents, licensors, agents, co-branches or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of the zWallet.com Service and/or Programs, the violation of this terms and conditions by User, Your connection to the zWallet.com Service and/or Programs, or Your violation of any rights of another entity."

I'm not defending zwallet or their practices - just offering the suggestion that this is not worth the trouble or efforts to expose or shut down the company - it's an unwinnable case if pressed. Thankfully all people have lost is time - and maybe dreams of possible earnings that will never be paid.

It stinks - but it's not illegal - or worth the time spent getting upset about it.
