I filed my 2007 federal income tax with H&R Block's TurboTax software online. The IRS recieved my income tax form electroniclly with all zeros on it. No one told me. When I didn't get my refund and stimulus payment, I called the IRS in Autstin, TX and they told me that they recieved it with all zeros on the form because someone else had claimed my dependent and to clear up the fraud, I would have to file a paper Amended Return.

When I called TurboTax customer service, they told me that thier software is linked to the IRS computers and when they saw someone else had claimed my dependent, it zeroed out my tax return automaticlly. WTF. So, after I cleared up the fraud and finally got my refund, the IRS refused to give me my $600 stimulus payment because they claim the law states that they cannot give it on Amended Returns and my original return didn't have enough income. DUH? it had no income (it was all zeros on the form). They refuse to acknowledge electronic error or any excuse. The law is the law.

Well, I say, THE LAW IS ON MY SIDE BECAUSE THAT WASN'T A LEGAL RETURN BECAUSE IT HAD NO INCOME TO REPORT AND THEY CAN'T COUNT THAT AS A FIRST RETURN. That defeats the purpose of the law to report income, if no income is reported and its all zeros on the form. Law 101. Its ridiculous. And, H&R Block doesn't stand by thier error, because it wasn't an error. The software did what it was supposed to do, keep me from filing a return that would have been contested. That's how they can guarantee they stick by the return. I was the victim here. By the way, the fraud person/s got my stimulus payment.

Who are you complaining about?

Turbo Tax is a software package that is put out by Intuit. H&R Block doesn't have anything to do with Turbo Tax. H&R Block has their own package called "Tax Cut". Which is it?

what you can do

If this happend for your 2007 taxes, you can try to claim it in your 2008 taxes. the 2008 taxes has a part where it asks you how much of the stimulus payment you received, when you enter 0 it will probably realize that you should have received 600 dollars (if you fall in that category) then credit you with 600 dollars for the 2008 tax return. If that doesnt work then I would send a detailed letter to them.

Here's your problem: if you claim the first return was legal, then you filed a fraudulent return and the IRS places responsibility for filing a return on the individual - not software. If you pay someone to perform the return, then the burden falls upon the person to whom you're paying. Filing a fraudulent return is a crime; the degree of which is determined by intent. If you claim the return was an error, then yes - an amended return would be necessitated, which then makes the IRS correct. Either way, you're out a stimulus check.

Whatever happened, you were going to run afoul of the IRS given your filing and it may have prevented the stimulus check from getting to you and it certainly would have delayed your refund. It certainly would have caused you other problems you otherwise avoided.

Sandy... There is no way for TurboTax to "zero out" any return. We would have no knowledge of whether a dependent has been claimed by someone else. Only the IRS would know that. It sounds like you received a lot of misinformation. About the only truth is that you will have to claim your rebate on your 2008 return. You could not claim your rebate on the 2007 amended return.

By the way, Intuit is the maker of TurboTax, not H&R Block.
