The Tax Club Ripoff They Don't Have a Clue!  Uneducated Advisers!  Beware! New York New YorkThe Tax Club is A Ripoff!

I spoke to Bert Seither during the initial free 30 minute consultation. He's very good at convincing you that they are the tax experts. I felt uncomfortable about the $2000 membership fee, but when comparing how much it cost me to do a personal tax return and a business tax return... to their low $240 a year fee for both returns, it seemed like a good deal despite the large initial payment. I also took into consideration that they offer unlimited phone calls to ask tax questions. And my accountant charges 275 an hour for questions. However, during all of my follow-up calls it seemed as though I know a lot more about taxes than the people that work for them.

Mr. Siether told me I could form an LLC for my business entity and be taxed as an S. Corp. I then spoke to a guy named Nosh at the tax club, who told me that was impossible. Then, during my bookkeeping appointment, I spoke to a seemingly uneducated kid named Daniel B. who continually insulted my bookkeeping practices. Telling me that his was more superior. He was rude and unprofessional. I also spoke to a guy named Larry Bookout during my initial consultation, and he knew nothing about the tax laws in California. Then I spoke to Adam Carroll about forming my corporation, and I had questions about the franchise taxes in California. I had two phone calls with Mr. Carroll, each time he told me something different. When they sent me my tax club binder,they actually sent two of them. When they sent me my "personal tax plan", they sent two of those also. It seems as though the left hand doesn't know what the right hand is doing. The "personal tax plan" isn't personal at all. They simply typed up my name and stuck it in the front of an already prepared generic tax plan. And now I find out that they don't really do any tax planning at all. I have to do all of the work implementing an insert teamed all of the information in their "virtual tax organizer". This is a very good lesson to check companies out before you join! I want to be involved in a class-action lawsuit. Anyone out there filing one please let me know how to contact you.

Everybody wants to sue!

"Adolph" had a post about a big bad class action suit against ebay. Guess who won???

You tell us:

The attorneys got about $850,000;
The two 'lawsuit organizers' got a "consultancy fee" of about $250,000;
The individual "injured ebay users" got NADA because their individual damages were too small to issue checks, so their money was given to charity.

Hi Cathryn, I agree with you 110%. These people have no idea what the h**l they are doing. It just kind of feels like the whole thing is a scam. I just wanted to let you know that there will probably be a class action lawsuit against these guys. I don't know if you were sold on incorporating in nevada, but here's just some heads up. The Tax Club not only has no idea how to prepare taxes, it also is now telling everyone whom they tricked into incorporating their business in nevada now has to file state returns where they reside. There are going to be a lot of very, very, very unhappy people. There excuse is that the tax law is changing all the time. It's funny really, because you think these so called "tax consultants" would know about changes that are about to occur. That crappy organizer is no better than filling in the forms yourself. I mean hell, last year I didn't owe any taxes and it took them two months to file my returns, and I had to file an extension just to be safe. We should definitely keep in touch, because things will definitely unfold within the next 2 months.

As an Enrolled Agent licensed by the IRS and a tax practitioner with over 25 years experience, I would have to say that Cathryn has a point. Some of what she was told by the Tax Club is blatantly false.

1. If you have an LLC you can choose how you want the LLC to be taxed. You do this by filing IRS Form 8832 Entity Classification Election. There is no rocket science in filling out this form - you neter the LLC's information and check the box. Toime to complete - less than 5 minutes.

2. I have seen some pretty bad bookkeeping practices in my day. All I ask my clients to do is enter all the checks, deposits and cash receipts/payments into Quickbooks. If they don't know how to classify the expense I set up an Account titled "I Don't Know" and I straighten that out quarterly. It's not wise to criticize a client's bookkeeping practices - you go with what they have. If what they are doing doesn't work, you show them how to do it better and easier.

3. A $1000 fee to pay $240 to get your tax return done? I'll do it for the $240 without the $1000 up front fee. And all my clients get unlimited tax consultations. I would rather prevent the problem with timely advice than have to deal with a problem later.
