This company has is something else, I bought a ring from them 4 years ago. Due to an unfortunate series of events I was unable to repay the debt owed for the crummy ring I was sold. A judgment was put against me and I tried to settle the debt. A conversation was held in October of 2011 and an agreement was made to settle in the amount of 455.00 thought the original balance was close to $1,000. 

In making this agreement a gentleman by the name of "MR. Alvarez" stated that once the payment of $455.00 was processed they would SEND me a document in writing showing the debt owed was SETTLED.

It is now February 2012 and I had yet to recieve my letter of settlement. I took the time to make a courtesy phone call and ask Mr. Alvarez where the letter was. Unfortunately Mr. Alvarez is no longer employed there. They claim that when MR. Alvarez and I last spoke an agreement was made and they would process a payment of $455.00 but the remaining balance was due. I stated that that comment was false and the agreement was I would pay $455.00 and that would settle the debt. Today Victor has told me that now because I defaulted on my agreement to pay back the settled amount he was going to recover the entire amount owed including court fees and interest. 

I asked one person if they record the conversations they have and that person responded yes and when I asked Victor again he stated that they only record a few conversations and the manager Alma stated that they record all but they dont have the conversations going that far back.

Now because of the poor integrity of another person, I am being told I owe more than what I can afford even though I held my end of the bargain. This is a terrible way to conduct a business and I have to say it bothers me that this is what corporate america is like. When I stated I didnt have the money to continuosly pay them, ALma said "well you will eventually and that is when we collect our money" I bet Mr. Alvarez told his boss "He can only pay back 455.00 and his boss  then said well collect that make him think it is settled and we will get him for more later!"

- Actually you did not hold up your end of the bargain.  When you originally got the loan it was under the agreement that if they loaned you the money, you would pay them back.   There was nothing in that agreement that said only when you could, which is why they have a judgment on you.  Had you actually held up your end of the bargain you wouldn't be in this position now.

But with that said, unless you have something in writing you just made a payment on a $1,100+ judgement.  As a hint for future "negotiations" they pretty much hold all the cards, so there is really no reason for them to settle.  Especially for what looks like only about 30% if you include all of the costs.  This is because with a judgment they can take other actions.  This could include Garnishment of your wages or attaching your bank account.  Not that they wont' settle, but it is not very likely if they feel like they will eventually get their money.

It may not help you now, but if you get them into the position of making another settlement offer.  BEFORE you send them a single dime make sure that you have it in writing as to what you are agreeing to.  If you wrote the $455 check from your bank account, I would immediately close it and open it up a new one at a totally different bank.  Because once you sent them this check they have all they need to get a garnishment order for your bank account, and with the judgement they can attach your account at any time without notice.
