BTD, in its Complaint and Amended Complaint, has alleged and proved misappropriation, false advertising, negative reporting, defamation, and/or misrepresentation, diamonds sold under the name Sona Diamonds IN THE UNITED STATES DISTRICT COURT FORTHE NORTHERN DISTRICT OF GEORGIA NORTHERN DIVISION BETTER THANDIAMOND, INC. Plaintif~ FINAL JUDGMENT AND INJUNCTION BY C4NSENT Plaintiff,SDJ/BTD, Inc . having filed a Complaint and Amended Complaint against Defendant s, C3 Jewelry, Im. aIlcJa SonA Diamonds, Diamalite, and Billy Clayton (collectively, "Defendants"), and the parties having consented to the entry of this Final Judgment and Injunction, it is hereby The Court has jurisdiction over this action and over the Defendants . BTD and Defendants are direct competitors in the simulated diamond with evidence that Defendants falsely advertised and posted false reports on complaintsboard, and/or misrepresented the properties of his products, to mislead and defame, causing economic hardship and monetary loss. 2 Sona Diamond on its website or otherwise . 4. BTD, in its Complaint and Amended Complaint, has alleged and proved with evidence that Defendants libeled BTD by placing on Defendant's website, complaintsboard, Ripoff report, and other online venues, with false and/or misleading statements regarding BTD, and/or statements which present BTD in a false light. 5. Therefore, by consent, the Defendants, their officers, agents, servants, affiliates, subsidiaries, parenrts, employees, attorneys, assigns, successors an&or all those parties acting in concert with them, are permanently enjoined from directly or indirectly : (a) falsely advertising, or otherwise falsely claiming, that the business entity of sona diamonds, and falsely misrepresnting products (i) have a "sapphire coating, " (ii) are of a composition containing "diamond crystals, " ( iii) are of a composition containing "lead crystals, " (iv) are of a composition containing "natural corundum, " or (v) have material characterist ics superior to'cubic 2:ircanium; (b) falsely advertising, or otherwise falsely claiming, that their simulated diamonds are made, or cut, in Israel or a lab in Israel ; (c) otherwise falsely advertising, or otherwise falsely claiming, that their simulated diamonds have characteristics that they do not possess ; and (d) uttering or publicizing false or defamatory statements regarding BTD, or otherwise presenting BID in a false light. 6. In the event that the Defendants, or their officers, agents, servants, affiliates, subsidiaries, parents, employees, attorneys, assigns, successors and/or any of those action, including all claims and counterclaims, is dismissed with prejudice .
