Richard is not being truthful about his job I have brought all the material over to his house except 1tree and 12yards of mulch which that will be brought over this week. On top of all this I have hauled about 56yards of dirt , 48yards of mulch and 1tree and I have spread and laid all the dirt and mulch that I have brought over. The reason for the delay is in Aug. of 2011 doctor's found a growth in my colon so I had to have surgery to remove the growth I was out of work for 9weeks then found out that the growth was colon cancer so I have been doing chemo treatments ever since and it does not make me feel good Richard knows all this I have been trying to get stuff to him but have been really sick past few weeks with chemo I have told him he needs to get someone to finish project cause I'm not able right now only then I'm going to ask when I bring rest of mulch and tree over is to pay me for the work I done at a reduced price due to the time I have been on his job

At this time there has been 1 tree delivered but you are backward on your amounts of mulch. You have delivered 12 yards.  I have had to hire someone to get the tree installed before it died. At this point I can only hope it makes it. I would cancel/settle the small claim I filed in exchange for the materials that I purchased from you. I did make an error in the amount in my first response. It was a total of  $1215.00 that I have paid for and have only received $380.00 worth of materials. I will correct this in my court filing. The fact remains that it has been since 10/07/2011 since I paid you and this is plenty of time to finish the job or refund me the amount owed which is $835 and that does not even take care of fine for not having yard in order from subdivision or having to pay someone else to install tree or the aggrivation of not having my yard finished.
