Vernon Horst entered into a four contract with our business to dig him a several acre pond on his residental property. The agreement was that we excavate the black dirt and sell it, he gets a pond. A year and a half into the project Vernon Horst asked us to do something illegal and against the Army Corp of Engineering's guidelines. We refused so he hired Dave Thompson to build a berm around the pond. The the authorities found out about the violation and Vernon was issued a cease and desist order which he did not tell us about. He directed us to remove the berm which we started to do. We stopped working on the site until we received something in writting letting us know what the guidelines were. By this time the DNR was involved, the county watershed district and the Army corp of Engineering. Vernon Horst put up a no tresspassing sign preventing us from our thousands of yards of screened and pulverized black dirt. He has refused to allow us to remove our Kabota backhole valued over $30,000 and various equipment attachments. He refuses to pay us for the dirt and the improvements on the property. He has continued to lie to the police about the ownership of the property. We are an established company and he has put us out of business.

Vernon Horst has swindled us out of Thousands of dollars. He as had several other contractors on his property digging his pond our understanding is that he has swindled other contractor's as well.
