I am going to point out some of the scams this business is using to make money.

* False advertising
* Unpaid Entitlements
* False Testimonials
* Working without licence

From the period of time I worked with Green Gardenz I witnessed an unqualified gardener claiming he has qualifications he doesn't. Charging people for work that wasn't completed, I was the supervisor in charge of specific tasks at hand and on several occasions I failed to complete these tasks but the customers were still charged for the work even though it is clearly stated on his website that there is a 100% money back guarantee.

A 20 Year Workmanship Guarantee in all landscaping buildings is promised, not only is this 100% impossible but it's stated on the website as accurate. and I quote.

 “20 year Workmanship Guarantee”. It means that for a period of 20 years, we will take responsibility for all defects that
could arise as a result of our installation. It also means that we will use the best specialists in all the requires fields to manage our projects"

He is a small business that has only 2 employee's, one is an assistant and one is a landscape gardener (ME) which refuses to put my name to such ridiculous claims. So there is already two points of false advertising.

How can you have the best specialists when you only have two employee's? Lets just forget about the many, many, many grammar mistakes on the website, which proves it's not as professional as he makes out to be.

He does not pay entitlements that are owed, such as superannuation, sick/holiday pay and other entitlements that should be paid are not paid. He is a thief, a liar and he should be punished.

This report has been written by an ex employee I had to fire because of poor performace, offensive and threatening beahviour towards his supervisor and customers

Hi, I am the owner and founder of Green Gardenz.

This report has been written by Shaun Kalnins. I had to fire him in October 2012, due to poor performance , threatening behavior, offensive language to wards his supervisor, and customers. Shaun Kalnins was warned several times verbally that his attitude was unacceptable, and he was given time to change. Shaun Kalnins also received as written warning.
This report is another testimony to his destructive personality and a poor attempt to try to get back at me.Shaun Kalnins also used the identity of his supervisor to file this report, which shows that he can´t take responsibility for his actions.
Shaun Kalnins has no qualification at all and was first hired as  a casual but after a month was offered a permanent position. Shaun Kalnins was paid $17.68/hour. According to the ¨ Gardening and Landscaping Services Award 2010¨. the minimum hourly for this position is $15.96/hour. This information is also available on the fair work ombudsmen website -fwo.gov.au/PayCheckplus, so you can check for yourself. So As you can see I was paying Shaun Kalnins way above award rates. So his claim are false.

I have to say the first couple of month, Shaun Kalnins fooled me and was doing all right. But as soon as he was offered a permanent position, he behavior completely changed.

Now, Green Gardenz carries a Landscape Construction License (No 238032C), and it is up to date, That is obviously public information and you can also check the validity of the license on fair trading website: fairtrading.nsw.gov.au.

Also, we employ qualified landscaper in our staff, and all of the supervisors license are up to date. So here again, his claims are false.

Regarding our guarantee, I totally stand behind it. In fact, there was one incident where Shaun Kalnins was involved. Shaun Kalnins damaged some property and tried to hide and ignored it. This caused the customer to get upset, and I gave them back their money for the whole job. Than Shaun Kalnins was confronted by the customer, and this is where the offensive and threatening behavior took place.  Need less to say, I lost this particular customer, and my reputation was also affected.
By trying to make his point, Shuan Kalnins actually admits in his reports that he did not complete his tasks...

Regarding entitlements, I can safely say that I have paid Shuan Kalnins every cent owed to him. He was paid one whloe week for his termination period (I did not want him back on site), I have paid all his holiday pay, I have all the superannuation. In fact, Shaun Kalnins has lodged several claims against me with the Fair Work Ombudsmen, and I am under investigation. But to this day, all his claims have been proven wrong, and I have not had to pay any extra money to him.

My only mistake is to have hired Shaun Kalnins. And I will say I am guilty of not checking his references properly. My advice to everyone here is if Shaun Kalnins applies for a job in your company, do not hire him!

I just wanted to add a development that happened recently after I filed the rebuttal tto the report above. I
have copied an email that I received from Shaun Kalnins, the author of
the report and one email from the Fair Work Ombudsmen. I have edited
them for obvious privacy reasons, but I have left the most relevant parts. They
are self explanatory and I trust it will help you form an educated
opinion about what has been reported here. As far as I am concerned,
the matter is closed.

I have recently been contacted by the fair work ombudsman

lack of producing the uniform. (...)

As a response to my termination of employment, (...) I acted in an immature way and
decided out of bad judgment to write several articles online that may
damage the reputation of your business. I do apologies for this, I
acted in an unprofessional and immature way. My actions at the time
were based on my direct relationship with my supervisor and by doing
so I have damaged your reputation and my own.

I made complaints against your business out of poor judgment and without
resolving it with you personally I have made personal attacks and
allegations based on my own opinion. I am well aware these comments
written have damaged your business and I wish to rectify this.

I was not aware the actual article I wrote was published, I have tried
many times to remove the article and have attempted to contact legal
advise to recifty the situation, my attempts have failed. you agree
to the accusations written against me in retaliation are also

Finalisation of investigation

Dear Pierre,
I refer to the complaint lodged by
Shaun Kalnins, a former employee of Greengardenz, on xxxxxxxxxxxx with the Fair Work Ombudsman in relation to non payment of overtime rates, underpayment of hourly rate of pay and non payment of all annual leave on  termination.

This office received confirmation from Mr Kalnins at 6 pm on xxxxxxx that he wished to withdraw his complaint (...)
and as such he no longer required the Fair Work Ombudsman to proceed any further with this matter. The FWO will be taking no further action in relation to this matter at this time, I will be acting to close you matter.
