This lawyer wile representing the worldwide asset purchasing llc, filed a motion to levy my account without serving me notice of court date so I default, then he waits 3yrs 2 months to levy. I cant find this so called credit card debt on my credit report at all and he filed 8 yrs after the last activity on any credit card I ever had. now he is trying to attacth my wifes paycheck and she was never a party to this case on any level. If you have had trouble with this lawyer or wwap help me out.

You are not alone. I represented a client last year who was in the same predicament as you. She had a default judgment against her over 2 years prior to her even finding out. Same lawyer, Mr. Clark. Same collection agency, Worldwide. I was able to set aside the default judgment by showing proof that my client was never served. When I showed up to the hearing ready to make my argument to the judge. I discovered Mr. Clark dismissed his law suit the day before and never told me. I was able to stop him from garnishing my client's wages. I wanted to take more aggressive legal action and sue them back but my client wanted to just move on with her life so I left them alone.

You may be able to do the same thing. Gather up all the proof of you and your wife never being served. I know its been some time and maybe you think there is nothing you can do now, but there is no time limitation on unwinding default judgments if you can prove you were not served. Legally, if the court never acquired jurisdiction over you, they cannot act against you, including the garnishment.

If you have a good case, a good consumer lawyer should be able to represent you for little to no cost.
