I own a limousine company which I specialize in town car service. It is similar to taxi, but we are licensed under PUC (Public Utilities Commission). Note: We have nothing to do with taxi. I have all my licenses. TCP licensing, Insurance coverage of over $750,000, my registeration, and my livery plates.

I got contacted by a "customer" to an ad that I had posted on craigslist, saying that they need a town car for that exact same day for $50 an hour. As soon as I went to pick up the "customer" I got arrested by the police and my car got impounded. They did not book me. They just gave me a ticket for using illegal taxi and my car got impounded by LADOT. Ladot is responsible for the licensing of taxis. They did not even take a look at my tcp number or the fact that I am licensed under PUC. They did not even let me explain the situation, nor did they explain why they were towing my vehicle.

Finally after 8 days of running around and trying to talk to someone, I was contacted by the LADOT by an investigator, apologizing and telling me to come and get a release form from them, so I can go and take out my vehicle from the impound place. But guess what??? I had to pay $550 to take out my vehicle. Anyways, I am willing to begin an action class lawsuit against this criminals. They apologize for their actions but yet I have to pay for all the damage.

I was humiliated and handcuffed and my rights we're not even been read by the cops.

This is a tough one...

Yes, your rights were violated here..on many counts. It can't hurt to ask around but unless this is happening to a substantial number of licensed limo operators, you may not find a law firm willing to handle this pro bono or on a contingency. Surely your false or "mistaken" arrest or "detainment" is worth something to you..as is not being read your Miranda rights...but that really does not mean anything other then if interrogated, that it could not be used against you in court. You really can't sue for that since there will be no charges filed against you regardless.

They are however responsible for the impound. I would find out if you are allowed to sue the LADOT. If so, a small claims suit might be a way to go to at least be heard, and have the impound fee refunded. I do not know if the mistaken "false" arrest is worth anything, I do not think you can sue for that if I recall the laws correctly, not in a case like this where all it really caused was inconvenience and humiliation. The police were simply doing their job, albeit a major screw-up occurred.

 Did you try contacting the LADOT to see if there is a way to be reimbursed for the impound fee? They may rather do that then deal with a courtroom and have this blunder further exposed. It may be a frustrating and time consuming process as with any city/state run agency, especially here in California, but if you speak to the right person, you may get some satisfaction. Did you contact the media about this? Tell the LADOT that is on the agenda as well as a small claims suit if they refuse to assist in the matter. I would advise not to be rude, but firm. This is a case of don't get mad, get even. Getting mad at a state/city run agency just puts you on a list of of around 20 million other people, take a number. If contacting them proves futile, then take further steps as necessary and allowed according to state laws and your rights.

LADOT has a contract with LAPD where LAPD officers arrest and cite drivers for illegal taxicab operations.  The contract allows all of the LAPD personnel to get paid on overtime to arrest as many drivers as they possibly can.  They have refused to accept the training and guidance of LADOT enforcement staff and mistakenly impound many cars with little or no reason.  Several vehicles that were incorrectly impounded have resulted in the cars being released to the owners but since owners dont know that the vehicles have been released due to inferior practices, people do not know to sue LADOT and LAPD.  LA County Superior Court Judge Vilar has ordered several vehicles to be released and for LADOT to pay the impound fees but this is something they do not want the public to know.

You are correct, TCP vehicles are allowed to pick up customers for prearranged travel as long as the words "Taxi" are not used during the transaction.  If a limousine responds to a telephonic request for a taxicab, the arrest and impound are legally justified.  However, I am aware of several times when drivers have been arrested unjustly and the SENIOR TRANSPORTATION SUPERVISOR (Pastor Robert Herbert Johnson 323-620-4340) and TAXICAB ADMINISTRATOR (Thomas Drischler) and ACTING GENERAL MANAGER (Amir Sedadi) are also aware of the flaws but prefer to continue the program for precious overtime that is actually paid for by a fare increase by riders of legal taxicabs and legal taxicab drivers in monthly dues to LADOT. 

Find you an attorney, and sue.  It's the only way to stop this unethical and often illegal action.
