As with every story I've heard regarding Bank of America, .. nothing but avoidance tactics, lies and deceit in regards to home loan modification.

It's now been over 6 months that I've tried calling, only to get a run around, e-mails even to the president of home loans, still delay tactics one after another.Been through the forbearance process, never late with a single payment, ..even got to the point where they actually sent me a modification agreement to sign.

Well, I signed it, had it notarized, included the requested payment and UPS'd it back with 4 days to spare. It got returned to me saying it wasn't notarized ( it was by an employee of their damn back ) and it didn't reach them by the dead line. I have the tracking info that shows it was delivered 4 days before the final date.

More delay tactics and BS.

It's time to stop this America !!!!!

Why modify fraud?

With the potential for fraud in mortgage contracts why would you want to perpetuate fraud?  The FDIC did a study and found that 83% of mortgages have fraud.  The way to find fraud if there is a crime, would be found in the paper work.  Solution, certified forensic mortgage audit, you know CSI style.  Tape off the crime scene and bring in the specialists.  This will stop them in their tracks.  The thought of these mortgages being audited and fraud being found terrifies these mortgage companies because they don't want to become the next Ocwen.  They tried to foreclose on a $31,000 mortgage and ended up paying 11.2 million to the home owner.  There is a company that provides certified forensic mortgage audits called endlessfrauddetection.com.  Your paper work will be gone over by a lawyer who has been certified by both National Association of Mortgage Underwriters and National Association of Mortgage Processors.  Once the violations have been identified either a RESPA letter or letter of Rescission will be generated.  The RESPA letter will be asking for more information, while the rescission letter will be asking for all monies back and starting over with the negotiations.  If the fines for the violations and the amount paid in total more than the house costs, then they owe you, not the other way around.    They also provide the litigation support paper work for your lawyer to file in court.  His job is 90% done.  The litigation paper work is based on your state laws and local laws as well and included all of the supporting case law and the laws that were violated.  At the top of their home page is a link to their radio show, Endless Fraud Detection Radio and on the rule of law website the Dec 3 and 17 show are with a client who had 17 violations, 11 of which were cause for rescission.  It only takes one rescindable violation to rescind the loan.  He was very surprised to find his mortgage had that many violations and depending on the violation and situation, some fines are treble making a once 2,0000 fine now 6,0000,  Those can add up fast when you have violations in the double digits.  Now lets take this country back one house at a time, starting with yours.

Ripoff Reports. It seems as though some legal documents were changed by someone in the processing of St. Clair's mortgage loan, right? That's FRAUD, isn't it?

Contact your mortgage company and get ALL of the copies of the paperwork that they received for your mortgage loan. Check to see if any "hanky-panky" took place regarding your loan documents. There is a chance that some, most, or even all of your loan papers were altered, changed, or even forged.
