I had been contacted by Jim at FLR and was told that I qualify for a home loan modification. I told him that I didnot have the money to pay them and he told me to pay them in 2 installments instead of making my mortgage payments and they would get my home mortgage modified.

I paid them the 3500.00 that they requested and then sent them all the proper paperwork and forms that were needed. My case was then turned over to Tricia Hansen and from there I waited to hear from her.

after 2 months i finally got in touch with her and since my mortgage had been sold to another company as my original company went out of business she said that she had contacted my new mortgage company and they were not doing anything with the morgages aquired from my previous company until 1 November.

I waited and as of todays date Nov.22, I have not heard from them at all and when I contacted my mortgage company and was told that they had not had any correspondence from FLR. I have tried to call numerous times and faxed letters to Tricia, I still have not heard from them. I feel that all they wanted to do was get my money and rip me off. If anyone else is out there do not use there services.

As of today my house has gone into foreclosure and I really do not know I will do if I loose my home

The reason why you most likely didn't hear back from that company is because most likely they are closed down. There were so many scams coming out of California in regards to loan modification that the CA Attorney General shut everything down. You need to contact your lender and work out a forebearance plan TODAY to avoid sale dates. I don't know what state you are in, but there are a lot of NON JUDICIAL foreclosure states which means you don't have court dates to have your house sold or foreclosed on. There are also some states that have "crazy" foreclosure laws, or lack of foreclosure laws rather where they can take your assets and house within a few months, whereas mostly everyone else would just be getting foreclosure paperwork (texas and missouri are two of those states). Some lenders are easier to deal with than others for borrowers to apply directly with them for modification. If you are Central Loan Admin. and Recovery ( previously taylor bean and whitaker), or with MGC from GMAC to name 2 then yes they aren't doing anything currently with bought loans, however with an actual attorney representing you they will. If your loan was sold to a collection agency (MGC) then you can file law suits with US HUD and actually win your house outright from the lender. I would strongly suggest that you stop waiting around for the California company and be pro-active instead of re-active in your situation. I work for a Real Estate law firm as a parallegal and we do modifications here and I have seen to many of our clients nearly lose their houses in the past because of modification companies. If you go to (((Redacted))) you can find some information on modification. Just make sure that 31% of your income  before taxes is below your PITI (principal, interest, tax, insurance) and that 55% of your monthly  expenses does not exceed your monthly income (back end debt to income ratio). You can file a report with the California Attorney General but be advised that you most likely will not recieve a reimbursment as the company most likely packed up and ran to avoid (if they arent already) jail time.  Also, there are non-profit agencies like US HUD, or "HOPE" as well as NACA who is also non profit and is HUD approved. Best of luck to you! Remember to call your lender's loss mitigation department and work out a forebearance ASAP!

I am very sorry but you fell for a very common and I think in most states at this time a quasi legal scam.  The truth is anyone can call their mortgage company at any time and try to get a loan modification.  The more reputable loan modification companies are just having you pay for something that you could easily do yourself with just as much chance for success as they would have.  The less reputable, as you found out, simply take your money and do nothing.

Telling you to send your mortgage payments to them instead of to your mortgage lender was completely bogus, as far as your lender was concerned you just stopped making your mortgage payments.

If the two missed payments are what caused the foreclosure letter then you need to call your lender and tell them what happened, assume they know nothing at this point.  Ask about a loan modification.  They may not do it but at the very least you can probably get them to work out a payment plan to pay back the two missed payments.

Just remember, doing nothing at this point is the worst thing you can do.
