I bought my h ouse in 2005 during the Housing boom and as in alsmot all cases, I paid an extreme amount for the Condominium. I had purchased my home loans through a family friend which got me two loans; both by Fremont Investment and Loan.

Fremont, which is now out of business, then transfers the loans over to HomEQ and Ocwen. I soon realized that I could no longer afford the Condo payments for both mortgages and contacted both for a Home Loan Modification. HomEQ, was very easy to deal with, Ocwen on the other hand was not.

Long story short, the Home Mod request was denied by both Companies and I soon filed for Bankruptcy in August 2010. The Bankruptcy was discharged, and to my understanding all debt reported under the bankruptcy I am no longer liable for. 

I purchased the Condo in Maryland and the state has a law where I still am responsible for the HOA Fees after the bankruptcy until the Condo sells under foreclosure. I contacted OCWEN today to inquire about the foreclosure sell and they inform me that I STILL OWE THEM MONEY FOR THE LOAN!!!!

I checked my credit report and it says that the accounts have been closed under the US FED Ruling.

I certainly feel misused. OCWEN was the company that offered me a Home Mod, I said I would agree and days later they tell me that the Home Mod was DENIED!

I feel that they are not doing any due diligence to sell this Condo and here I am months later still paying for the HOA fees.

Not only has my credit report been tainted for the next 10 years but it still is continuing today if they do not get these house off the market.

If any lawyer wants to contact me please do. It seems the offer of a home mod and then a rejection has happened multiple times. This company denying the Home mod has ruined my credit for the next 10 years.

To clarify, HOMEQ transfers their part of the loan to OCWEN during my bankruptcy filing.

Sounds to me that they're trying to bypass the bankruptcy.

Ben, you jumped the gun on the filing of Bankruptcy

Ben,

It appears that you jumped the gun on the filing of your bankruptcy.

You never file bankruptcy until someone actually takes action against you that you want to stop like wage garnishment, etc. The entire reason for bankruptcy is to protect your money and property from seizure.

You should have filed re-organization instead of liquidation.

OCWEN is horrible, and I know many people that are currently dealing with them, or have dealt with them. I can tell you for a fact that the ONLY way OCWEN will even consider dealing with you is if you are at least 90 days behind in your payments, AND they don't want your house back due to being "upside down".

If you have any equity in your home at all, OCWEN will not deal with you in your favor. They WILL take your home.

The bottom line here is that you bought something that you really could not afford, and that was your fault. Then, you ran up your credit cards and other bills that you couldn't afford to pay back on top of the condo you couldn't afford.

The BK is what ruined your credit for the next 10 years, NOT the loan mod.

You should have just lived in that condo for free until you were tossed out and then waited until the last minute right before they sued you for deficiency and then you could have included the HOA claims in your BK.
