Flamingo Finance Over 20 Calls Per Day at my place of work, Threats, Refused to allow me to speak to a manager ripoff Ocala Florida

Approximately 2 years ago I purchased a mini van from a local truck dealer in Port Orange, Florida. Financing was done through Flamingo Finance in Ocala, Florida. Like most of us I fell on hard times. After paying a week ahead for 2 years I got behind 2 weeks of payments. The first week I started receiving phone calls. On a Monday I received over 20 calls from Flamingo. They never left a message.

Finally I was able to answer the call. I asked if that person had been calling previously and was told no. I told him I received over 20 calls and was told "too bad, you'll continue to receive the calls until you pay up!" I then found out that they had been calling a friend of mine, who I listed as a reference, 3 or 4 times a day looking for me. I told the person to stop making those calls. He assured me he would.

I received calls the next day and asked for a supervisor. The person refused and said if I didn't make the full payment that day they would take the van. I again demanded that they stop making calls to my friend/reference. They assured me they would and 5 minutes later out of spite called him again. The calls continue to come daily.

Tell me again why this is a ripoff? I missed that part...

You signed a contract. You have failed to live up to your end of the contract. Yes, it's rude that they call, but hey, they have every right to do it since you have not caught up on your payments.

And, for the record, "MOST OF US" have not fallen on hard times. Not trying to sound condensending here, but obviously you have sub-prime credit because of your loan company, and the reason you have sub-prime credit is from not paying your bills on time, bk, charge-offs, etc..., and all your doing is feeding the fire again. You need to pay your bills on time, and you won't get these phone calls. It's not a ripoff, it's called responsibility for your actions.

Calls to any 3rd party violates section 805(b)2 of the Fair Debt Collection Practices Act. After contacting the collector by mail that you do not wish to receive calls at home, work, cell or any other location by phone the collector DOES NOT have the right to contact you according to the Fair Debt Colelction Practices Act [15 USC 1692c] Section 805(c) CEASING COMMUNICATION. Do your homework Dave.

FDCPA Applicable IF They're A 3rd Party

You're absolutely right if Flamingo was a 3rd party to the transaction. But, from your OP, you financed the van through Flamingo. So, they aren't a 3rd party to the transaction and therefore the FDCPA doesn't apply to them......... they can make all the calls they've done. It stinks, but it's legal. Just about every 1st party lender does what this company does to effect collections, and all of it is perfectly legal.

Do what you need to do to pay them; find a friend and borrow the money. Unless you're out from under these clowns, they're going to keep calling and calling every person you know.
