For the last Year I have had nothing but problems with Sallie Mae. A year ago I filed my taxes and was supposed to get $5061. On February 11, 2011 I received a letter from the Department of the Treasury Stating that Sallie got all $5,061 of my taxes. A few moths later I received a letter from Sallie Mae Stating that I owe them 11,199 that I have not made one payment to them. I wrote letter after letter Stating that they got all of my tax return so why wont they accept that as a payment. I get another letter from them stating that I have never made a payment to them which is a lie I got the letter from the IRS stating they did so I to BBB and made a complaint against them. They finally called me back and I received a letter from Sallie Mae Stating they would not take my taxes anymore because they are going to look into it which is a lie. This year I filed my taxes I was supposed to get $2,019. Well that did not Happened I got another letter from the IRS Stating that all $2,019 will be going to Sallie Mae. So they got a total of $7,080. I want to know why they can keep taking my money and then turn around stating They have never received a payment. Why do they have the right to keep sending me a bill when they got their money? This is not right! Either someone is a thief and taking the money for themselves or they are trying to rip me off. What am I supposed to do live the rest of my life while Sallie Mae takes my Taxes every year for the rest of my life? It has been a year this has been going on and it continues to go on. This should have already been resolved yet I am still sitting here waiting and they keep bullying me and trying to get money from me that they already got. I am asking anyone and everyone to please help me with this, I am afraid Sallie Mae is trying to rip me off and steal my money.

OK, so let's try and see what's going on here. You had a student loan through Sallie Mae. You don't state the original amount, but let's say it was around $15,000. You didn't make payments or arrangements for a forebearance, so you were in default. The IRS takes your refund. That amount is applied to your principal. But because you're in default, you still owe a ton in late fees. So Sallie Mae tells you they received your refund and have applied it to the principal. Year 2, you're STILL in default so they take your refund once again.
Confiscating your refund doesn't count as a "payment" in the sense I think you're talking about. Even if it did, it would be counted as ONE payment, not enough to cover the other 11 months until it happens again.
You screwed up by not taking responsibility for your loans. Grow up.

Where in this "RipOff" do you deny that you have delinquent Student Loans?
Student Loans are not like other debts. If you are delinquent they have the right to take additional action. This includes intercepting your Federal Income Tax Refund. So in answer to what I believe your question is..YES as long as you are delinquent on your Student Loans they will continue to intercept these funds. Keep in mind that these intercepts are NOT payments.
Now, there are a few ways to avoid this from happening. One is of course to contact them and see if you can get on a payment plan, but if you are still in delinquent status they may continue to intercept your refund. Which brings up another way, but if you haven't figured out how you can keep them from taking your REFUND in the last couple of years it would be meaningless to tell you now.

WOW your telling me to grow up when you do not even know what the hell you are talking about or what I have been through. Unless you Know the whole story do not Judge me. No It was not a delinquent on a Student Loans? it was not even for a student loan at all. Not to mention I was making payments of $50 a month and at times when I had more I gave them even more and I was never late. I always paid it on time. that was the agreement I had with Sallie I done this for 2 years and all of a sudden they got greedy and wanted more. In the beginning I only owed them 4,000 Sallie Mae got greedy and wanted me to give them $200 a month instead of what I was giving them and I could not do that with being a single mom of 3. so all of a sudden my loan went from 4,000 to 11,000 no that is not right. I have every piece of paper they gave me stating I only owed 4,000 and every receipt showing what I paid them and for your info what they are doing to me is in fact against the law I have already talked to legal aid about it and showed them everything and they even tell me what they are doing is against the law. Look it up my dear. I am not the only person they are doing this to in fact there is hundreds of people with the same problem.

- THEY got greedy? They are just wanting you to pay back the money YOU borrowed from THEM. I am guessing that the $50/mo "agreement" was not the original terms and at some point they agreed to adjust the payments for a period of time.

- Being a Single mom of 3 or 300 doesn't change the terms of your loan.

I don't care one bit what you think because I know I am not in the wrong here. They are I take my responsibilities very serous and that is why I have 3 jobs so I can mange all my responsibilities. Besides Are you a lawyer or do you know the law? Unless you do you should not go running your Mouth about shit you don't even know. you ask what laws are they Breaking? well they are breaking a lot and according to the legal aid and yes he is a Lawyer that I have been talking to and seen all my paper work told me that they are 100% breaking a shit load of laws. Did you know there is already a lawsuit going on against them right now because of them doing this to other people. Another thing $50 a month was what Sallie Mae set up for me Not me. I tried paying more because I wanted it paid off fast. one month I gave them $300. that is $250 more then they wanted me to give them in one month. Which by all means I found out last month I should not have even given them a dime since I am not responsible for this debt because it was never mine. It was my ex-husband who took it out in his name and because I was married to him at the time they also put my name on it as well and I had no knowledge about it until I left his a**. So Like I said it was not for a student loan. I have never ever once went to collage. The reason I paid it for a few years is because I was stupid I believed it was in my name too so I did not want it to ruin my shit. He was not paying a dime on it. The few years I have been paying on this debt I kept every copy of the money orders and copies of the bank statements Showing that they cash those checks and I was never late on them . I have proof of the 5 thousand they took from my taxes which they claim they never got the 2000 this year they claimed they never got. Which tells me someone in there company is pocketing money that does not belong to them. Also the Lawyer told me BY law if if they have a payment plan set up with you. they have to stick by it.

You are a real winner there Robert! I bet you are one of those rich snobs who turn their noise up to the less unfortunate. You set there and judge people because they didn't go to college. That is messed up. So what if she has never went to collage that does not make her dumb or less human nor should it mean people can use or take advantage of her. Saddly there are more women in this world who gets ripped off or used because they are down on their luck. It really is not right. It really makes me sick that people like you think they are better then others. People like you should not even exist in this world. There needs to be more kindness in this world but Instead there are more assholes like you who set there bashing women.

Wow – you really don’t come here much, do you? First of all, Robert always posts helpful advice, typically on financial issues. Nowhere in his posts did he imply that the OP was dumb or less than human.
The OP HERSELF left crucial information out of the first post, leading readers to an inaccurate conclusion. The fact that the OP is a woman is irrelevant. If she was a man, he (and I) would have probably posted the exact same responses.
I don’t recall Robert ever mentioning being rich, or taking a position that he was better than someone else. He merely pointed out that the OP had to take responsibility for what was happening, and offered her logical advice on how to do that.
YOU, sir, are the one who needs to practice more kindness.
