On 6/2/08 I was contacted by Security Finance about my monthly payment. They also told me that I had a bounced check from February in the office so instead of my monthly payment for $78 it would be ~$145. Since I did not have that much I sent my boyfriend the next morning to drop off a post dated check for the amount and if they would not accept it to pay them and I would pay him back. When he picked me up from work, he said that they had accepted the check. ( The check was dated for 6/13 which is my payday since I get paid once a month).

On today 6/10/08 they call me again to tell me that my check was returned. I told her that the check was not written for the 3rd but for the 13th and that I had to carbon copy to prove it. She insisted that I changed the date and I know that I did not and like I said I have the proof. My bank says they cant do anything and that I should go to the magistrates office. I have filed a complaint with the Better Business Bureau and on tomorrow when my stimulus check clears I will go to the office and pay in cash minus any returned check fees and if they ask for them I will be going to the Magistrates office and press charges.

Post dated checks

Anytime you write a check, even post-dated, the law does not require the recipient to hold the check until a later date. When you write a check, if you don't have the money in the bank to cover it it is considered a check written on insufficient funds (bogus, rubber, etc.). What you might do in the future is go into the Security Finance office, sit down and talk with the loan agenct. They are generally willing to work with you in those type businesses. I know this because my relative is a manager with Security Finance. They would rather a customer at least work with them through a struggle than to have to "write off loans." The company was not guilty of check fraud because they deposited a post-dated check. When you write a check you need to ensure you have the funds in your bank account to cover it; otherwise you can be charged with writing a check on insufficient funds, which is against the law.
