Toyota Motor Credit Corporation Reported a repossed vehicle that was not repossessed. My credit report is now blemished. Rip-off in Torrance, California

While going through a divorce, I was ordered to return a vehicle I leased from Toyota. At the same time, I gave them a copy of the court order.

About a month later, I was contacted by their collections arm (which I expected) and was told that they had repossessed my vehicle (unexpected and a big fat lie) and that I owed thousands of dollars.

We made an agreement for me to repay the money and that they would remove the 'repossession' from my credit report...However, even though I paid according to the terms of the agreement, they kept the false repossession on the report and listed the account as a 'paid-charge-off' (A horrible blemish on my credit report).

I have contacted lawyers to get this resolved but am told that there is nothing I can do. So I am telling other people to watch out and to get everything in writing.

Dear Joe:

Toyota Motor Credit Corporation (TMCC) is an abusive financial services company that promotes this type of unlawful activity against consumers all across the great U.S.A.

Section 611 of the federal Fair Credit Reporting Act (FCRA) requires all consumer credit information being reported by a Subscriber to a credit reporting agency (CRA)--i.e. Experian, Equifax, or Trans Union--to be CURRENT, ACCURATE, AND VERIFIABLE.

As a consumer, you have the right to dispute a credit report with both the Creditor, Toyota Motor Credit Corporation (TMCC), and the credit bureaus.

Process and procedure is specified in Section 611 of the federal FCRA. If you would like to learn more about this consumer law, you should go online to the Federal Trade Commission and search for its publications on credit reporting and FCRA.

In addition, I have compiled a long list of regulatory agencies that should be posted on this site on where you should file a formal complaint againt Toyota.

It is your duty as a responsible citizen to file your complaints with the designated authorities to make sure that this company is held accountable for the abuses and offenses it commits against consumers all across the country.

If you live in the western United States, your vehicle was most likely repossessed and confiscated to a lot in Mira Loma, CA, where TMCC stores over 3000+ impounded vehicles.

Notify the authorities of the crimes committed against you. You indicated that you have documentation. This is your strong point, and will be a great asset in fighting back and making your case.

Contact the regulatory agencies that I have listed in the Bad Business Bureau website.

I sympathize with your unjust experience. You are not alone. This is how the company conducts business.

As consumers, we must stay in control of our financial capital. Do not patronize businesses that look to abuse, exploit, and extract unjust enrichment from you. For large purchase items like home mortgages and auto loans, do business with a credit union or other financial partner that you know well, and has your financial welfare and security in mind.
