My husband and I got a car loan back in 2008 so I could have a car to go back and forth to work in. Well, When my husband left the army we came back home to Pa. He took a state job and the lovely governor didnt pay him for over 4months. Well all our other loans places for our other truck and our home etc understood, they just need a letter from his employer. Which we got them all including Wells Fargo. Well since day one they have called us every day monday-sun from 7am till 11pm every hour on the hour. Telling us we are deadbeats, no good that we are skipping out on the bill. I have proof that before this we were on time and even early. Now I have told them over and over the federal act"Fair Debt Practices act" says they are only allowed to call one time a day mon-fri from 9am-5pm. They tell me they dont care that it isnt a real act that I am just making it up. Now I am coming here. I really dont know what to do. We were put in this problem cause the state governor can not settle on a budget. I have come to this I really dont care anymore if they cant understand about the state budget but they can fallow the FEDERAL LAW.

Has anyone else gotten this unprofessional,haressing, demeaning, racist, rude, phone calls?

I understand your frustration..

But what they are doing is unfortunatly legal..

The Fair Debt Collection Practices Act(FDCPA) ONLY applies to 3rd party collection agencies.  Wells Fargo is considered the original creditor and are not bound by it.  So in that respect they are correct it is not a real law..for them.

By the way the FDCPA does not specifically state when a debt collector can call.  It just states that they can not call at a time they know to be inconvinient.  Unless they know otherwise that is taken to be 8am-9pm 7 days a week.

Section 805 - Communication in connection with debt collection

(a) COMMUNICATION WITH THE CONSUMER GENERALLY. Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt—

(1) -at any unusual time or place or a time or place known or which should be known to be inconvenient to the 15 USC 1692b 15 USC 1692c 6 § 805 15 USC 1692c consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o’clock antimeridian and before 9 o’clock postmeridian, local time at the consumer’s location;
