back in june of 2008 I was layed off and fell behind three months on the third month I sent three money orders for the full amount and they were returned. then the problems started I am disabled and my husband is the only one working. my grandaughter is 18 and goes to school and has a baby. mr medina is the only one that works and provides for us. when the monies were cut and couldnt meet all payments and school for her and baby needed clothes and diapers. I also have my two parents that live with us which are 84, 85 yrs old.

I called to get a loan modification with acorn housing which is a government agency that helps get mod. loans and they could not help and told me not to send payments anymore because they were working on the loan mod. well I just fell farther behind. then in the months I filed bankruptcy and somehow information was lost and miscommunication with the attorney and the bankruptcy was dismissed it was chapter 13 that went under my name. that got ruined and still sent payments then they were not accepted, they got returned.

time went by again and still nothing could get resolved. I kept calling and at times just gave me the run around call this and call that but never got any answeres. I dont know why I have been switched to four different companies and in the switch they lose payment or not post them, then they wanted me to sent more money which we did but still never caught up. then the forclosure was stopped and sent payments again and they accepted only a few. then they sent a letter again that they would foreclose.

I filed this time chapter 13 again and stop the forclosure again and but went to the hearing and my husband speaks no english and the lady that takes care of the chapters was upset because she did not speak english. she had to get an interpreter and she was very upset. our attorney did not get full information on us and was lacking alot of paperwork and so she said she give us 14 days to bring in information. which my attorney never did. it was dimissed again. I just recieved a letter for the court date to get permission from the judge to forclose on the house again.

I am very frustrated with these actions and nothing seems to be resolved and just keep spending more and more money to pay the mortgage, pay the attorney, pay fees, and nothing has been resolved. I guess this time I will lose my home which has belonged to my parents for the last 46yrs and now we lose it to some people that dont even exist in the united states they are I was informed somewhere in Idia and the people speak very poor english I cant even understand half of what they say and all they do is agree to everything you say and cant resolve anything.

other than say ok ok and transfer to everywhere else but to resolve and issue. at this point I am so disappointed that there has been no one to help you other than push you deeper and take your money. I dont understand how this could have happen other that they lie and steel from under your feet. not even going to the district attorney will help because you have to have an attorney and they cost money. its all about money. I know as its said money talks and all others walk down !@#$ avenue.

I wish all people that are in the same bind as we could all get together and sue the heck out of this company and see if they can be broke but they are so rich in money that they know they will not lose. the way our economy is right now and will be worst too many people are losing their homes and well it is getting rediculous that we are all losing everything we own....can anyone outhere help!!! or have other suggestions or techniques....Help!!!

My American Dream has been turned into the American Nightmare as well. My loan started with TB&W and they were shut down by the feds in 8/2009. I was attempting to get a loan mod with TB&W before they were ever shut down. My loan was trasnferred to Ocwen. I sent Ocwen two qualified written requests (per RESPA laws, google for a template, it's simple). They ignored the first letter in 2010 and in 2011 they responded by telling me I had to pay for the documents. I was simply asking who the note holder was because I knew something just wasn't right. I recently had a securitization audit done on my loan and found out ALOT of interesting things. I found out that my loan was sold by TB&W three mths after I purchased it to a nameless and faceless investor on Wall Street. My home has actually sold about 3 times since I signed my promissory note (this is happening to everyone). So if you pay your mortgage for 30 yrs and expect to get the title then think again. All of us have been paying ''rent'' to some investor and you will not see your title in 30 yrs like you think you will. Then the real ''owner'' can come along and make you pay for the house all over again because you paid the wrong entity. I encourage everyone to do your homework and fight these fraudster ''pre-tender'' lenders. Go to your local county courthouse and get a copy of your deed. If you see ''M.E.R.S'' (Mortgage Electronic Registration Systems) then beware because you don't own anything you just think you do. I'm educating myself with all the laws and verbage (alot of the words they use do not mean what you think) so I can stand up and fight my case in court. Welcome to America people, where the rich get richer and the poor get poorer. Please google the UCC meanings of - promissory note, nominee, beneficiary, depositor, creditor, drawer, drawee, blank indorsement, and any other ''mortgage'' term you run across. Also, look into The Bill of Rights, Declaration of Independence, and The Constitution. I'm amazed at what I'm finding out....hope this helps some of you. You have to be prepared to fight because knowledge is POWER. If you don't know the laws when you present your case, you will not and cannot win. Ocwen doesn't want to modify anything (they can't they only service loans), they want your signature giving them rights to do what THEY want. Only the ''holder in due course'' can modify your loan.
