Massage Envy Stuck with a contract for services I cannot use Spring Texas

I signed up for a Massage Envy contract on May 30, 2009. I fully read and understood the contract at the time I signed it and was fully prepared to pay for and utilize my membership. On July 7, 2009 I was informed by my employer that my work schedule (until further notice) will be 6am-10pm 7 days a week. Obviously this interferes with Massage Envy's clinic hours. I sent a certified letter on July 8, 2009 to the ME that I signed my contract with and was contacted a few days later by a representative stating that I cannot break my contract unless I move 25 miles away from an ME location or have a written note from my doctor stating that I cannot receive massages due to health issues. My only other option is to freeze my account for up to 6 months. Since I do not have a specific time period for my new work schedule, I am not sure if a 6 month freeze is feasible for my situation.

They are unwilling to work with me on this and as a consumer I feel that I should not have to pay for something that I cannot take advantage of. I have read of early termination fees in forum posts on websites, but when I questioned the representative about this, they stated there was no such thing. This is the only contract I have ever entered to that does not have an early termination fee of some sort. Basically what I was told is that I am stuck paying them $49 a month for the next 10 months no matter what. The regional manager that I spoke with a couple of days ago told me that I could of course cancel the credit card that they have on file, but they would turn that over to collections and be successful in collecting my membership dues. Honestly, it is a hassle for me to cancel a card just to get out from underneath a contract. The only way they could ever be successful in obtaining funds from me if a collection is filed is for me to pay for it, which totally voids the point of cancelling the card in the first place.
Another person I spoke with at Massage Envy told me that if I do get a break from work that I could come in to get a massage and they could unfreeze my account on the spot. I told this woman that if I do get an extra hour in my day, I am not going to spend it getting a massage. I would much rather spend it fulfilling all of my obligations at home that I would not otherwise have a chance to take care of.

All I want to do is be done with this place of business and return to my life.
