Biotab Nutraceuticals Scam Artists, Where is the class action lawsuit? Monrovia California

Their advirtisement states that when you order the free trial you are automatically enrolled in their monthly program and will be billed accordingly. If you call customer servise after your initial order you can cancel enrollment in the monthly program. I placed my order for the free trial on July 15th,2008 , I called customer service 2 days later on July 17th after I received my confirmation via email from biotab.com that my order will be process n 2-3 day. Whe I spoke with a rep. I was told that they had no record of my order. I called again on wed July 23rd and was told the same , no record.At which point I replied to the confirmation email and told them since it had not been processed to cancel my order. I got a reply stating they need my customer number and invoice number to access my records. of course when I call back ,they still have no recored of me so no customer number. On August 13,2008 I was billed for the shipping on my initail free trial order and on the 15th of August I was billed for a month refill (50.00).I called customer service again, explained the situation , they requested I fax them the email confirmation I recieved in July and I did, they did not call back . After several attempts I was finally transfered to supervisor Kevin (ext 341) and he said theres nothing he can do and "so whats your problem"...insructs me to just return it then.
This has to be illegal in so many ways!
I have since been charged another fee of 1.49...I am bombarding them with emails and have filed a complaint with the BBB, next will be the FTC after i close my checkign account.
Any advice here, and why has there been no legal action.We cannot let these people get away with this.
