I have been contacted many times by phone & by mail from several credit debt collectors in an attempt to collect on a debt they claim I owe First Consumer's National Bank. This has gone on since 2002 and the most recent letter arrived today from a Merchant's Credit Guide Co out of Chicago, IL.

I have never had an account with First Consumer's National Bank & when I ask these places to provide proof of said debt, no one yet has been able to produce that proof. I have not been able to contact First Consumer's National Bank about this account because they no longer exist.

I have actually sent a letter to the US Attorney General's Office to have this matter looked into for fraud, as no account has ever existed for this bank in my name. I have yet to hear back from anyone concerning this matter.

Hector,

Even though you may not have had an initial debt from First Consumer's National Bank, it may have been purchased by this bank or the bank may have changed names.

If the above is not the case and this has been reported to your credit report, I would suggest contacting the 3 credit reporting agencies (Equifax, Experian, and Transunion) and disputing the debt in writing. Once the dispute is filed with the credit bureaus, the creditor has to prove the debt is valid. The three bureaus have to notify you within a certain time frame (i believe it is 30 days) and let you know of the decision. If they choose not to remove it based on information from the creditor, you will receive a copy of the documents provided to the bureau.

I would also check to make sure you were not a victim of identity theft. Check your credit report if you haven't already for any discrepancies. If so, contact all three bureaus and alert them you think you are a victim of identity theft.
