I gave Ameriquest money to keep a house after I had filed for bankruptcy. The home I was trying to keep was discharged in the bankruptcy, however they never reaffirmed the loan, or gave me back the money. They also didn't tell me that I couldn't or shouldn't be giving them the money because the house was included in a bankruptcy. After I found out that they shouldn't have taken the money, I tried to call them to get my money back but they would't return my calls or send me anything in the mail. They ended up taking me to court over non-payment of the house in April of 2007, not only did they get the house but they also got the bulk of what I paid them after the house went into bankruptcy. Money they shouldn't have kept in the first place. Please help.

Who was your BK attorney??? That's who you need to start with.......

I would start by suing your attorney for the bankruptcy. Did he not tell you that all items included in the BK would be handled through him and the bankruptcy court? Also, once you are behind on payments ANY loan company, bank, mortgage company etc. can refuse payments that are not in full and up to date. When a forclosure occurs all the money you owe on the loan, plus the cost of foreclosure (which isn't cheap) is collected. I would go after the lawyer that ripped you off.....
