I played the late fee game from the third payment on. It started when i drove to the salt lake city branch to make a payment. upon arriving i was greeted by the branch manager who accepted an endorsed veterans disability check and reciepted me showing the amount the date and his name. two weeks later i recieved a call from california asking for my payment, after frantically researching why i was not credited for the payment i found the guy was holding my endorsed check in his desk because he was told that this form of payment was not allowed because the check was not made out to them. of couse i was assesed late fees up the wazoo which after several months was up to thousands all because this moron was not smart enough to get my check back to me in a timely manner not to mention the fact he did accept and reciept my payment.

the next two years i spent paying every penny i had attempting to keep my house long enough to find an honest lender but not before two years was up since the early payoff clause was two times the amount of the actual payments for a penalty. when i finally made it to the two year mark my payments jumped up $500.00 a month, and of course they did not hesitate to tarnish my credit keeping any decent company from lending me a way out. but that was nothing compaired to the world ending phone call i got from a guy who said he baught my house at an auction and wanted to know when i planned on moving. of course i responde by saying the hell you did my house is not for sale. yes they sold my house at auction without following state required laws mandating the ways i should have been notified prior to any auction and then payed my attorney to help them get me out. i had three offers from cash paying buyers that were over $300,000.00 dollars and could have even filed chapter 13 any of which would have protected my equity but only if i would have been given the notice required by law. for the record i can prove without a doubt any and all alligations but i cant muster up the cash needed to pay for the court to hear my case because they milked me of every penny, all credit, and took twenty years off of my life from the trauma of losing my life savings to a pack of lying greedy wolves. i need help and dont know where to turn!

Mike,
So you drove 30+ miles to dropoff an endorsed government check made out to you in the hopes that Ameriquest would accept it as payment? Are you serious? Do you have that much free time? No company in their right mind would accept it as payment and while the branch manager has the IQ of driftwood, he was still smart enough not to deposit the check.

Here's a suggestion, have the check directly deposited into a bank and then use their free online billpay to set up automatic regular payments to your mortgage company with a due date that coincides with when you get your government check.

Last but certainly not least, Ameriquest is a sub-prime mortgage lender who deals with "B" and "C" customers so your credit was probably already "tarnished" to begin with. Considering how you pay bills, I'm not surprised. If Ameriquest had in fact sold your house without going through proper foreclosure proceedings, you'd have 50 lawyers knocking down your door to sue them.

I DONT UNDERSTAND HOW A LATE PAYMENT DUE TO SOMEONE ELSES MISTAKE WOULD CAUSE YOU TO BE FORECLOSED. THERE IS SOMETHING MISSING FROM THIS STORY. WHAT HAPPENED TO THE NEXT PAYMENT?

I thought anyone getting any kind regular gov check had to have it directly deposited into an account. I though they made it a law a number of years back.
