In October of 2005 I lost my job and was out of work for 6 months. I was late on my mortgage payment in January of 2006 and then PHH Mortgage refused to accept payment and attempted to forclose in March of 2006 even though I was willing to pay my mortgage payments. I was forced to hire a mitagation company to try to remedy the matter and they did nothing to help the situation. I filed a stay in order to try to halt the forclosure and the judge set the hearing date almost a month after the scheduled auction date on my home. After much time and money I came to a agreement that nearly tripled my mortgage and paid $4900.00 in Fees. Even though my credit was ruined by this incident I was able to obtain another mortgage and have been trying to rebuild my credit in order to get my life back to were it was prior to what PHH did by refusing to accept my payments in January of 2006.

Your Cendant / PHH mortgage should have spelled out what you could do if/when you were late

... with your mortgage payment. Usually your mortgage will include a provision stating that you have a grace period of 1 month, or 2 months at the max, to correct your payment deficiency. If you were correcting your deficiency *within* the stated grace period, rather than calling them about it, then you should not have had a problem and the mortgage company was in error. If your mortgage lacked such a provision then you know now why you want that provision.
