I had been doing a little research on Cendant Mortgage's foreclosure practices and found some interesting articles.

I fell behind a couple of mortgage payments in April/March of this year. I sent one payment in the end of April in a feeble attempt not to fall too far behind. (This would have put me behind one payment). On May 8th I received my mortgage payment back, not cashed, with a letter stating that it was insufficient and now Cendant wants 3 payments to bring my account current. I obliged. On May 25th I sent Cendant overnight 3 separate payments (one for each month) in certified funds (good as cash) to where I normally send my mortgage payments. These were signed for and received on the 26th. At this point in time someone made a CONSCIOUS DECISION not to accept my certified funds which would force me into foreclosure.

I was given two ridiculous reason why they did not accept my money.

1st I sent it to the wrong department. I sent the certified funds to where my mortgage payments are made. I was told it should have gone to a different department which tell me there's no communication between Cendant's Departments. Picture if you will, If the person receiving payments sees that I owe 3 payments and in their hands they see 3 payments in certified funds (in full and overnighted!), one would think that should send up a red flag? This leads me back to my conclusion that it was a CONSCIOUS DECISION for Cendant not to accept my payments.

2nd I sent 3 individual payments in certified funds. Cendant wanted 1 payment. They received their payment in full and they're not satisfied with the number of payments made. WHO CARES AS LONG AS IT WAS PAID IN FULL AND IN CERTIFIED FUNDS!!!

Without written warning, on June 1st Cendant initiated the foreclosure process. I was told by Cendant they do not know where my funds are and that they will mail it back to me when they find it (even though I told Cendant where the funds went and who signed for them). In the mean time I'm out of my money. I'm being told by Cendant that I still owe that money and after June 1st I'm being charged daily fines until it's paid. Worse of all, I now can only speak with their lawyers and legal fees will follow.

Instead of let's help our customers out when they're in need it's more like "LET'S PILE IT ON AND BURY THEM!!!"

My first mortage company was cendant. They tried to foreclose on us

Good luck, our credit is shot because of Cendant. They are the top of the list worst. Everything you said happened to us. We refinanced and wound up with a great mortgage company. Then we refinanced again and wound up with another company like cendant. It seems to me mortgage companies like to foreclose. They make it hard for you, lose your payments, lie to you. We were told once by Cendant it wasn't our home it was thiers (cendant). Again, Good Luck!
