Our two years of hell with Centex Home Equity LLC. We fell behind in our house payments due to a temporary forced suspension at my employment. We explained this to Centex to cover our house payment. They starting by taking more money than the agreed dollar amount out of our bank account. Which caused overdraft fees through our bank. The never told us about their $15.00 processing fee for the check by phone service.
Their letter allerting us of the amount that they would be taking out of our bank account always came after the transaction instead of the 5-10 days prior according to law. These letters never had dates on them as to when they were sent out. I'll bet there copy did. When we stopped payment on one of the transactions due to receiving one of these letters with no date and for the wrong dollar amount and the wrong check number I told my bank not to honor any transactions from Centex from that day on! Then the phone calls started at home, at work, or wherever they could get ahold of me. This was happening 5 to 6 times a day.
From early in the morning to late at night even on weekends. I was awoken early one morning to one of these calls and was promptly asked when I would be vacating the premises. Two hours later I was told I would be prosecuted Criminally for writing a bad check which was never written or sent to them. After four months of harassment and mental abuse we contacted an attorney in Jan. of 2003. He negociated a 4 month loan modification with Centex. Centex agreed this should give us an opportunity to refinance.
Wrong, Centex aparantly made our credit report say paying as agreed; 120+ days late. No one would touch us.So we are stuck with Centex who would gladly refinance us for the same terms as before. We then contacted the Kansas State Banking Commission who licenses and regulates mortgages and brokers in our state. It took two attempts for Centex to respond to them. The State Banking Commission told them that they could not have a prepayment penalty and their interest rate was to high according to Kansas Usury Laws. Which is what the mortgage was governed by since they chose to abide by Kansas Law. They (of course) disagree to their own mortgage and asked for a ruling by the Kasas Attorney General. The State Banking Commission agreed to turn it over the the Kansas AG office for a ruling.
Cented promptly had us served with forclosure papers the next day. Which stopped all involvement of the Attorney General Office, this was October 15,2003. We have filed a counter claim and asked for a jury trial, but they don't want one. According to the Kansas State Banking Commission the whole mortgage is illegal. We have been hit with thousands of dollars in charges and have no equity left in our home. This has not been settled yet and Centex is very slow in responding to our Attorneys request for information. Is there a time limit on how long a forclosure motion can sit without it going to court? As we just found out the Judge had set a motion for dismissal for April 30,2004. We finally just this weekend(May 8,2004) got to see the letter from Centex's Attorney asking our attorney to stop the dismissal Hearing!!!!
This has been going on for 2 years and could have been settled a year and a half ago, but Centex is out after one thing our house and the equity that once was there. Centex is also aking us to pay 14 months of interest that has accrued due to there lack of response to our Attorney,State Banking Commission and to their own Attorney and The Court. The duress and harrassment that Centex has put myself and my family through is almost to much to bear.How can we stop them.

This is so typical of Centex. They drag on the process to make sure the statute of limitations is over. Unfortunately, you are in a similar boat as the rest of us, however, you have an attorney helping you. There are other places on the web concerning mortgage servicing fraud with just the same as you. I am also a victim of Centex and have been fighting with them for 1 year now. I just got an attorney and we will be seeking damages, which your attorney should also do. Well Centex has not let up. They have made us an offer they think we can't refuse! All they have agreed to do is lower our interest rate by one and a half percent(almost). They are still demanding all of there bogus charges and a prepayment penalty which is still illegal in Kansas. They have agreed to clean up our credit report by suppressing the negative information so like it was never there.
What does suppressing credit information really do? Does it help or hurt your credit? But we still have that nasty little prepayment penalty to keep any other finance company from taking us. Before it was the credit report now it is that illegal penalty. it has been almost a year since we were served our foreclosure papers and we still don't have this settled. Centex is a predatory lender in the purist form.
Why some state or government agency has not put them under investigation for predatory lending is beyond me. I am a former customer of Conseco and also Beneficial (household finance) and they were no where near as bad as this company!Anybody got any more suggestions my attorny I think is tired of messing with this and I think he wants us to agree to this latest offer and sign away our rights. At this point we do not know what to do anymore. Two years of this &$%# is enough and I don't think our attorney is of much help anymore.

Hi Wayne,
Have read your recent response. I am also a victim of Centex and yes, they are, by definition, a predatory lender. Contact the National Community Reinvestment Coalition in Washington, DC as they have a Consumer Rescue Fund and may be able to help. DO NOT SIGN A THING WITH CENTEX!!!! They will try to take away your rights and then you will have no recourse if you lose your home. Start documenting everything from telephone conversations, to whatever is being done in your case. If your attorney is not up to speed with this, then seek another attorney. There are other consumer attorneys who are willing to help, just in different states. Also, go to MSFraud.org, yahoogroups.com and sign into Littonloansucks.org site. Also, contifairbankssucks.org site. These groups have help for you. I can only give you so much help here. But, there is help out there as there are many, many of us fighting for the same thing. I have been in contact with some other Centex victims and we are all working together to help each other and to see if we can make a difference with lenders/servicers like Centex. I am not an attorney and cannot give legal advice, but can tell you what I have done and what works and what hasn't worked for me. You need to first get a copy of your account by writing a Qualified Written Request. Go to the HUD site as they have information on how to write one, they have a sample letter. This modification you are talking about is probably for 6 months? Am I correct? as they tried to do that to me and then they wanted me to sign a release, which you will give up your right to cure the problem in court. Centex is hoping people like you and me will do this so you and I will have no recourse to what they are doing. Also, as far as the credit report is, there is nothing that I know of suppressing your credit history. There is a form Centex can fill out which will delete the derogatory information about you. They will refuse to do that, as they have with me, but as a consumer, you can call the various credit reporting bureaus and tell them you are disputing this credit history. They will contact Centex to see if this is correct. So start letter writing. Centex is not going to let up. That's why all of the victims of this company have to come together to fight them. We are better in numbers.
