Chase Manhattan Mortgage ripoff - payments made to previous Co, Chase misapplied Refuses to correct Westminster Colorado

In July of 2001 Chase Mortgage took over my loan from Temple-inland mortgage. I made my July payment to Temple-inland because I did not recieve the notice that Chase Mortgage was the new holder of my loan until after I had made the payment.

In July of 2003 Chase Mortgage Collections Dept. contacted me to notify me that I was behind 1 month on my mortgage payment. They then at that time explained to me that in July of 2001, that they had misapplied a payment of $1078 to my account, this had been discovered through their internal audit so they had reversed the amount off of my account.

The employee that I had spoke with that day instructed me to fax them a copy of the July 2001 payment (cancelled check). I did this within 5 days of recieving the call. Then within 30 days of faxing this information to them, they contacted me again stating the same thing. This is now 2004 and I am recieving calls on a weekly to daily basis. I have faxed them all the information that they required SEVERAL times and they are assesing me a monthly late fee of $30.

I have tried to refinance the house but due to a structural damage, I am unable to do this. My main goal to refinance was to not only lower the monthly payment but to mainly get away from chase mortgage. I have spent a lot of money in obtaning and faxing them proof that I have made my requied payments, now I am losing several hundreds of dollars a month due to the inabilty to refinance.
