My wife and I owned property that EMC held the mortgage on. The loan was for $400.00 monthly, and $200.00 for an escrow account to pay our taxes and property taxes.
One day we get notified that our house insurance is close to expiration, we call to verify that the insurance was going to be paid. We first called Texas, they had us call Ohio, and they told us the check for insurance would be issued. However, two weeks later we were notified that our insurance had expired as no check had been received. We called Texas and they told us they had cancelled the Escrow Account.
One would think that since it was in the Contract, they could not do this. They did do it, and ask about the $200.00, they said they wanted it all. I said no, and EMC said they would sue us, we would be kick out of our house. I said I would sue them, their response was simple, "we will just keep on continuing the case, you and your family will be out on the street".
They did file for foreclosure, we filed Bankruptcy as the property had received back water over 8 times. The back water had completely filled the crawl space, it may not had came into the house, but all insulation were tore loose, and the beams all showed extensive damage. We had flood insurance, but the water never came into the house.
In January 2008, the new owner who was remodeling the house for his mother-in-law, sustained flood damage. 2 feet of water enter the house. I felt sorry for him, as it purchased the property at the Sheriff sale for $30,000.
Recently my wife received a check on the FTC suit against EMC. This company could had been stop, however, the Illinois Attorney General Office refused to listen.
