GMAC ripoff sucks Waterloo Iowa

My problem stated Jan 2007. When Gmac sent us a letter stating we missied a payment in june 2006. We proved we didnt missed payment then they said it was from may 2005 we proved yet again we didnt missed this payment.

Our lawyer went to court with 1800.00. The judge order gmac to accept this payment and evey payment after this and to refund our late fees. You want to know what happen they returned this payment to us and every payment since now we are behind. Stating they want us to do loss mitigation. Dont know what this is and gmac will not explain.

So one again our lawyer call gmac and they will not returned his phone calls. So this leaves us in a hard place because now no one will finance us. They are ruined us. If someone can help us I would like this.

GMAC THINKS ITS ABOVE THE LAW

Hello Carol,

I suggest you have your attorney write GMAC a letter demanding that it immediately cease and desist in its efforts to illegally collect money from you.

Furthermore, file a motion with the court so that you can tell the judge that GMAC is violating the court's order. Have your attorney ask for sanctions, attorney fees and cost, injunctive and declaratory relief, and any other relief the court deems just and proper.

A forbearance agreement is not appropriate nor necessary because you are not delinquent in paying your mortgage obligation. This is an attempt by GMAC to extort money from you and steal the equity in your home.

If I were in your shoes I would file a suit against GMAC, because contrary to what GMAC thinks it is not above the law!

Very well put!

But I may add to Virginia's comment; Make sure you SAVE ALL CORESPONDENCE from GMAC and your attorney. Prior to opening any letter date it for the date you received it, to where the date will be torn in half while opening.

Also start a file so you will be able to find that one exact letter in a drop of a hat.
I was told to do this and I thought I did, but when that one paper is needed its hard to find!
I speak from experience I've been dating GMAC for over two years at two different courthouses looking for a third. GMAC will not back down period, put your seatbelt on and get a grip, this could take a long time.

BTW: This is not a scare just a pre-warning of what may happen.

I have two words to say "law suit"

Hi Carol,

Your situation is basically similar to all the rest of us who have been doing battle with GMAC. I have notice two things that I have done that has gotten a quick response from GMAC. I filed a complaint with the Department of Corporations and I filed a 5 million dollar lawsuit in civil court for negligence, fraud and last but not least intentional infliction of emotional distress. It seems to me that you can prove all of the elements for the above. And just remember GMAC or any other Lender is not above the law and you need to let them know that you are protected under RESPA guidelines. Enforce your rights...
