When I became behind on my mortgage payments the company immediately sent me to the lawyers to start foreclosure proceedings. When I called before it got to that they would not take the money I had claiming that it was not enough. But later they charged me an additional $6,000 over the past due amount in lawyer charges. We had not even gone to court yet and I had to pay court fees for them to draw up a 3 page forbearance agreement. They asked for 2700 down and then raised my monthly payment from 650 per month to 920 per month for the next 18 months. I never recieved a breakdown of the fees from the attorney's office and when I called to state that I had made the payment Western Union the 2 women I spoke to at the attorney's office had no idea what I was talking about and they have yet to send me a letter stating that the money was recieved. I had to call the loan company and figure that out.

I am really sick of being penalized by always being stuck with mediocre predatory lenders. I used to be a loan officer and I never sent my clients to places like this no matter what their credit history. Nobody deserves this. Things happen all the time. It should be a better way to deal with late payments than instant foreclosure and high fees to an attorney that does nothing but type a few pages.

Taking Responsiblity

AUTHOR: Anonl - Oak Lawn (U.S.A.)

After reading this report I was not surprised at all! It's funny how people lay blame all the time everywhere else, but never point the finger at themselves. Unfortunately, not everyone knows the rules and laws when it comes to foreclosures and the law firms that are representing the mortgage companies. I am an ex-employee of the firm in this report.

First off, people need to understand when they sign with a mortgage company they are making an agreement/promise!!! to pay back any money borrowed and also with interest. IF YOU DO NOT! it states that the mortgage company has the right to take away your house! If you can't live up to this than maybe you shouldn't be buying a house! Secondly, whenever you try and contact a law firm who is representing your mortgage company, they cannot give you any information or advice concerning your case...they are not your lawyers, it's illegal! So maybe that was why they were short with you in this instince because they knew the laws and knew that it was illegal to give you any information you were requesting, at which time u should have proceeded to contact your lawyer or the actual mortgage company.

Knowledge Helps

AUTHOR: Anonl - Oak Lawn (U.S.A.)

First off, foreclosure is an unfortunate occurrence, and can be very difficult for those getting foreclosed on. However, I'm sick and tired of people who can't pay their bills blaming everyone else. To the above statement, that's correct; when you buy a house and take out a mortgage, you are signing an agreement/contract to make monthly payments; you don't...then you don't get to keep your house.
Foreclosures also have a process. I find it hard to believe that as SOON as you missed a payment they referred you to a lawfirm.

First of all, because our law firm doesn't even see a referral from a mortgage company for a foreclosure until about three months after the first missed mortgage payment. Mortgage companies work with home owners to try and get them back on track to keep their house, they don't want to foreclose on your property because nine times out of ten they end up losing a lot of money. I've seen so many stories on the news about families being foreclosed on and am sick of how they portray these families. I'm not a cold hearted person and hate to see people in difficult times, but one story caught my eye recently. A woman was being foreclosed on and the news had her story and her on camera crying and crying, "oh they're taking away my home" blah blah blah...what the news program failed to tell you is that this woman hasn't made a mortgage payment in over 7 YEARS!!! and has filed for bankruptcy 6 times in those seven years!! Come on now....

And as to the "It should be a better way to deal with late payments than instant foreclosure and high fees to an attorney that does nothing but
This comment realllly made me want to respond...First, the better way to deal with this, is um, pay your bills! And secondly, the foreclosure process is a state mandated law, so it varies state by state. The process could take anywhere from 30 days like in Texas, 9 months in IL, and in some cases up to 2 years. There is alot more than typing up a few pages. This infuriated me so much!! For someone who has no idea about what goes on when working on a foreclosure to speak on its behalf as if we are high school students typing a three page report on history or something. There are over 10 individual deptarments in law firms that deal with foreclosures, each one having a specific duty in the process. These processes are sometimes very tiring and strenuous.
I know things happen in peoples lives and not all people who get foreclosed on are bad people, or irresponsible, but the law is the law, and its clearly stated and to be understood.

Next time you want to file a report on a company, please make sure that you have all of your information correct. Because my job is more than "typing a few pages".
