I filed a bankruptcy back in 2005. My mortgage was NEVER part of the proceedings. Now after all these years, I'm told by Vanderbilt that My mortgage was cancelled and I no longer have a contract, just a rental agreement. I was actually told by Robin Taylor of vanderbilt that I have been allowed to stay in my home because thay let me. I was never notified by them that my contract had been altered or cancelled until just a few months ago when (due to the economy) I got behind on my payments. I never recieved a reaffirmation agreement from them even tho Robin Taylor says I did. If I would have recieved one I would have filled it out and sent it to them. I NEVER RECIEVED ANYTHING FROM THEM. Now I am being told by Robin Taylor that I have to be gone from my home by Nov 2 or she will have the sheriff remove me. This all seems to be surreal and almost impossible to find another place in under 2 weeks. I have recieved NO notices of eviction or foreclosure or anything except the threats from Robin Taylor. I have pleaded and begged them for any assistance and they just absolutely will not budge. I've asked for a refinance, a modification or even a new loan so I can stay in my home and all I've gotten is threats that if I don't pay the late payments I will have to vacate. I owe for July, August ,September and October and that's it. I am currently working again and could make a payment but just cant come up with the late payments. If anyone can help me with this matter I sure would appreciate it. I'm sure there is some sort of legal action I can take to stop this but I don't know what to do. Please advise me as to what action to take and I will do it. I am at my wits end and am getting REALLY tired of having to deal with a cold hearted %^&$# like Robin Taylor.

Reaffirm

I assume by your notes that you filed chp 7bk. In any bk you must include all debts in the bk but you may reaffirm the debt you plan on cont to pay (mortgage or car for ex>) as long as the judge oks it. Your att would have gave you the paper to sign not vanderbilt. You are 4 months behind and i am sure they have sent it to legal by now to start all repo actions. You can talk to your bk att and ask for reaffim agreement. You are still paying the payments to stay in the home but are not legally required to pay and can leave at anytime since it was included in your bk so you are kinda like a renter, except if you payoff the mortgage the home would be yours as normal. They are well within their rights to go ahead and repo and you are 4 (now 5) payments behind.
