Washington Mutual Home Loans made up late fees failure to notify of payment changes wrongful allocation of funds ripoff Milwaukee Wisconsin

In January of 2006 I received a letter from a lawyer representing WAMU in the foreclosure proceedings on my house. WOW! BIG SURPRISE! Well, I called them to ask how this was possible and was told that I had not made a payment since Oct 2005. Since this was all news to me I asked what they had been doing with my checks seeing as how they had all been on time and had been taken out of my account.

Well it seems that my payment had went up (because of escrow) 11.00 a month.So like the geniuses they are, they took 1 months payment(which was short 11.00) and held it until the next month came and then took the 11.00 out of that month to make the first one whole and put the rest in suspense!

I asked why I had not been notified of this and they said it was because I am currntly paying off a chapter 13 bankruptcy (which they are not involved in)and thay could not send me anything letting me know my payment had went up.

Well I got that much worked out with them (hopefully) but then like a week later someone from there called me and said that I owed over 1000 in late fees!

They said that I would owe for 39 late fees which I find hillarious since I have only had the loan for 35 months!! I have since gotten my loan straightened out but refuse to pay the late fees (maybe some but not all).

My biggset concern is that they can foreclose or hurt me in some other way over these late fees. Any help from anyone would be greatly appreciated!
