Scottsdale cop followed my boyfriend and I into the gas station less than 1/4 mile away from our house - off of Miller Rd. & Mckellipps Dr. - coincidentally, right across the street, is the newly opened Scottsdale Police Station. The officer parked discretely in the side parking lot and looked up my plates, as my boyfriend pumped less than 4 dollars of gas into my newly leased 2003 Jeep Liberty.

Apparently I had been driving on a suspended license, for failure to appear in court on previous speeding charges, via photo radar. No notification of so-called court date nor license suspension was ever sent to my registered address. But, police officer failed to acknowledge any of these claims, and abruptly cut me off mid-sentence and walked back to his car with our identification.

Roughly, twenty minutes later, a second police car pulls up, and arrest's my boyfriend on a bench warrant for speeding violations. Officer returns to my window, claiming they found a small drug seal (bag) while searching my boyfriend. Which apparently gave them probable cause to search my vehicle, and didn't find it necassary to authroize my consent prior to them assertively tearing through my vehicle.

Both police officers approched me and started to further harrass me on the amount of belongings and "junk" that was in my car, I felt it was nessacary to mention that my boyfriend and I happen to be raising our 18 mo. old toddler, and just recently had to move and are temporarily staying with our parents, both ignorantly rolled their eyes, claimed they found paraphernalia in the car that I had never seen or been of my possession.

One of the officers then continued to harrass me, and rudely asked me to empty my pockets, cooperating fully, he wasn't completely conviced so he pointed out the small jean pocket On my right side and as I prove to him it's empty, he still felt the need to stick his hand in there for himself.

Distraught and violated, the officers continued to be unethical or professional, letting me know that they were sending a K-9 Unit to sniff for any illegal substances I may be hiding.

For some reason I guess they decided to leave out the fact that they were lying, or give me any update on my charges or vehicle, until the tow truck pulled in and asked me to sign the impound papers.

Never would I have imagined that an Officer, or even a human-being for that matter, could have felt any bit justified by actions displaying such unprofessionalism, or respect.

You had no idea of that you had charges against you - Don't believe that. Your boyfriend is arrested for outstanding warrants and the police were doing their jobs. More than likely they ran the vehicle plates and found out that (if the vehicle was registered in his name) that he had warrants -

If the police find drugs or evidence of drugs they have probable cause to search the vehicle in question - they also have cause to search YOU. They seached the vehicle and that vehicle was according to you your boyfriend's NOT yours

Grow up - you have a child and you associate yourself with a criminal - good grief

I am AMAZED...

That I know more about your "rights" and what you should do when approached by the law than you do.

The first thing you do when approached by a law enforcement officer, is shut your mouth. So many people violate their own constitutional rights without any help from Johnny Law. Then, they whine and moan about how their rights were somehow "violated".

Allow me to point out some fallacies you've allowed yourself to believe:

1) The cops don't need your prior notification in order to act under the law. In regards to your suspended license and failure to appear, which normally results in a bench warrant for your arrest, your prior knowledge is not a prerequisite  for them to act on such a warrant.

2) Drugs found on your boyfriend's person does give them probable cause to search the vehicle. His possession of even trace amounts of any illegal substance gives them reason to believe that there may be additional substances concealed inside the vehicle. To be brutally honest, best way to avoid this is to avoid the urge to "clean the bag" and get rid of it. In addition, what you've arrogantly missed, is that once they have probable cause, they no longer need your consent to search.

3) Although it's none of the cops concern regarding the "junk" in your car, you should still resist the urge to open your mouth and start offering them information. Your best bet? Say nothing regarding anything not having to do with the immediate situation. Their job is not to give you sympathy or "cut you a break" regarding the care of your child. Their job is to arrest you, charge you and assist in your conviction. You know on TV how you see cops saying "cooperate with us and we can help you out"? DON'T BELIEVE A WORD OF IT.

The only words that should have come out of your mouth at this time, were; "Are you detaining me, officer? Or am I free to go?"

4) An officer is entitled to assure themselves of their safety. The cop questioning you about the "change pocket" on your jeans did not violate your rights. He did not pat you down, right? I know those pockets are located nowhere near the genital area, and are thus exempt from the regulation requiring a female officer be present and conduct the search. If the cop had insisted on giving you a full pat down, including your breasts and/or genital area, that would be a different matter.

5) Exactly how is letting you know your vehicle is going to be searched by a K-9 unit continuing "to be unethical or professional"? You cite this as some sort of further "violation", but even mentioning it in a negative light makes you look like a whiny twit.

6) You say they "claimed" they found paraphernalia, which implies they never showed you the items in question, but then you go on to say that you had "never seen it before". Which is it? Cops usually love displaying that crap like some sort of trophy.

7) You accuse the cops of "lying".. How, exactly, did they lie? Were you not wanted on a bench warrant for failure to appear? Did your boyfriend not have in his possession the remnants of a controlled substance? Did they find paraphernalia or not?

It pisses me off that you have some really great rights within the Amendments of the Constitution, but so many of you often blow three to four of them right off the bat as soon as Officer Friendly moves your cheese.

A little education goes a LONG way, and pretty much everything I've pointed out above is backed up by the ACLU themselves. In fact, they've put out a wonderful video that addresses your particular situation in the very first segment, "the traffic stop", in an excellent manner, and I would HIGHLY suggest you watch that segment, so that you can feel the crushing weight of exactly where you fouled it all up and perhaps learn from your grievous error:

All I Can Say Is...

That's a good story, I'd stick with it. Who leases a 7 year old vehicle? Who pumps less then $4? I like the way you put in "my registered address". How would you know what it is, moving around as often as you do? Both occupants of the vehicle have warrants for their arrest. "Claiming" to have found a small drug seal bag while searching boyfriend. What was in small drug seal bag? "Claimed" they found drug paraphenalia that you "had never seen or been in my possession". Spoken like a true j-bird. I like the legalese. Hence the "new" leased vehicle. Leftovers from the last owners? I like the "cooperating fully" part. I suspect it's kind of hard to get a hand into a small jean pocket. I REALLY like the "distraught and violated" part. It adds just a "touch". Yes, mama, you throw in ALL the right phrases. MAYBE if you file some type of assult charges, just MAYBE they just might be willin' to drop or lesson some of your pending charges. Who knows, it just might work.
