I simply need to talk with a customer service representative from JC Penneys.

My account got behind the first part of the year due to several reasons.  Being on a fixed income and unforseen financial hardships, JC Penneys changing my payment due date in mid stream with no prior notification so that I would be late and charged late charges and interest that was not due.  I am homebound , had been very sick, in the hospital, etc., did not receive my disability income for the month and just about anything you can think of during the past few months.  Now JC Penneys has turned my account over to a collection agency and will not allow me to talk with anybody at JC Penneys.

I have had a Penneys credit card for about 40 years and have always paid it.  I can't believe they can be so rude as to not notify me about the payment date.  There is no way that I can pay the full balance now, and want to ask Penneys to consider taking the account back, let me get my account balance current (I can do that now), pay JC Penneys instead of some noncaring finance company.  Do I not have the right to at least speak to someone at Penneys?  I have never heard of such??  As I said, I am homebound, in ill health, near indigent, but I do want to do the right thing.  I do think Penneys owes me some kind of compensation for what they did about getting my account so far behind by changing the payment due date with no notification.  This is all I can do.  My medications and medical expenses will not allow me to borrow money and pay the full account balance.

Please write me and let me know about talking to someone in your customer service department about just what has happened.  I know I should have paid some before now, but I have not had it.  I have just now finally gotten back on my feet a bit so that I can make my monthly payments,,,,,that is if the payment due date is not changed and the late charge, which is more than my payment, is not added every month.

You have a couple of issues and it seems as if you may be taking a few big leaps.  You say you initially got behind because of finanical issues.  Yet you seem to think the reason they turned you over to collection was because they changed the due date?

You said that you were not given prior notification.  Does this mean that you were not sent statements, or that the statements you were sent had a new due date that you did not like?  Because if you did not receive statements and that caused your problem then they could be violating the Fair Credit Billing Act and you may have some recourse.  Although for this you would have to do some additional research.  However, if they sent you statements and you just didn't like the new date, then the problem is on you.  Because it is well within the terms for them to change your dates.

- To be honest with you probably not.  If Penny's Charged-Off and sold your account to a collection agency they no longer legally have the account.  So there is nothing for them to talk about.  If they just transfered the debt but still hold the account they can talk to you, but are under no obligation to.  The only reason that they would take the account back is if they feel that you would pay it off.  However, with the description of your financial situation that seems very unlikely.

As a final note, if you are truly in the finanical strain you are in.  One, you should not be using credit at all.  Even if you did get Penny's to take the account back and somehow got it current, they would still close out your account, which they are totally in their rights to do.  Two,(and something to think about) you may be what is known as judgement proof, in that even if they did sue you for the money they could not collect.   Although for this you would want to talk to a lawyer where they can look at your entire situation.
