 My dispatcher booked an expedited team load going to florida for $3200 on 7/26/13 to be delivered next day scheduled for 8.30am delivery.On our way,the truck broke down at lousiana.We drve it to the mechanic around there but they didn't have the parts to fix it.We managed and drove it to Road runner service point in houston tx and their phone no is 713-675-5110, it cost $610..eventually my dispatcher called and left them a msg. that we had a break down and that they can reschedule us for the next day. In the morning,they called me to know where we are at that time so as i was narrating my ordeal,i started hearing anotherman'svoiceyelling at me, and i told the my age and he said he was sorry.i also let them that even with the time i got loaded that we couldn't have made it to Miami by 8.30am. they sent another fax copy of rate confirmation that the load now pay $1500 and should be delivered on monday. i told them, that i already took fuel advance from my factoring service and with this change, that i'm owing my factoring service $200. since it is now partial i'm already at a loss so i decided to pick some partials. my dispatcher told them i will deliver the load by wednesday.

unfortunately i had another problem at Slidell Lousiana.I drove my truck to TA  with phone no.985-643-9974 and we paid $737.34.the next day,somebody called my dispatcher from houston and demanded to know when we will deliver ,she told him on wednesday and the man said it was okay with him.he was their customer.later a lady from the same number called by name sylvia and demanded to know where i was. i told her that i was in Florioda so she said can i go to Miami and be there by 6.00am.i said yes so she asked me how much more i need so i said anything.Sylvia offered me $500 and said she was gonna call the broker 1AINTERMODAL to send me another fax. Sylvia told my dispatcher to call them so when she did, the man at intermodal asked her why she should get $500 more. My dispatcher answered that maybe the lady was sympathetic because we already lost so much to fix the truck and we aint making no money with that.The broker instead reported me to TIA and said he's not going to pay me a dime and that that i demanded the $500 from Sylvia which i never did. I pledge you use your strong office to investigate this matter and do justice to it.thanks for your co-operation.

On 7/25 we booked a load with Rose/Donald @ chirokee, to pick up the same day in Houston, TX and to be delivered the next day 7/26 at 8:30am in Miami, FL as an EXPEDITED TEAM driver load. the pay was $3200 for 3 pallets. After chasing them and calling them all day long the next day, we found out their truck supposedly broke in LA. They did not call check the night of the 25th nor in the morning, and by 8:30am, we found out that, they were still in LA (supposedly). They sent a false truck repair ticket, as we noticed it had a 7/23 date on it. When we questioned about this, and about the delivery, asking them to solve the issue,

the driver don, started to yell and curse our dispatcher, stating he would not deliver, that he would only deduct $400 off the freight to deliver Monday, and that, if we needed the freight back to Houston (to work it as a regular LTL for our customer), he needed money to, and never answered the ph. Anymore. We thought about declaring the load stolen, but finally were able to talk to Rose in dispatch. She apologized for everything and agreed to a new rate of $1500 USD for a Monday 7/29 8:30 am delivery. We sent in a new rate confirmation, showing again, expedited for Monday. Both rate confirmations signed were very specific in saying: “….needs to deliver on X date, or charges will apply”.

On Monday 7/29, we could not get a hold of them, they didn’t answer the phone in all day, and we finally got in touch with them on Tuesday 7/30. They said they were not deliverying the load, but until Wednesday 7/31 in the afternoon, because this was not an expedited anymore, but a regular partial load. They kept changing and violating the contract all along. Finally our customer involved upper management, and we had to disclose all the spooky driver and dispatcher contact information. Our customer kept calling them and they would only answer the phone to them (281 area code), and not to us. The driver don,

then asked our customer for $500 USD extra (to the already signed $1500 USD for Monday delivery), to be able to deliver on Wednesday. Off course, our customer was upset and scared, because of these people. After many calls (from our customer and ours), they answered back on Thursday 8/1 stating they had a breakdown again, and, that they will not deliver that day, but on Friday 8/1. Finally, we found out from our customer that the load delivered in good shape (strangely, only 1 driver delivered, and not a team driver). Because of this breach of contract (back solicitation, rate confirmation agreement modification, and non-delivery when they were supposed to) NO freight charges will be paid, and they will be held liable in court, for any damages related to non-delivery of an expedited team driver load.
