1st Resolution Investment Corp, Providian National Bank, LVNV Funding, BanCorp, Providian Financial, Wash Providian resold and resold my Charged Off Account To Several Providian Affiliates and a Credit Collections Attorney? who gained a judgement against me utilizing serving me to late to appear in court or answer his charges for $14,010 and I was/am on SSI/AFDC and Exempt: it all started just after 911 RENO, Nevada

I'd had to file a bankrutpcy (that has been removed from my credit report now). But, shortly thereafter, I obtained two Providian CC's in order to start to rebuild my credit. Then, my New Husband maxxed both the cards up on me (worse, they were in my name only) and then, he bailed out on helping me cover the debts except, for a joint CC; He is my EX now! But, I faithfully made the payments for these Providian CC's until, 911 affected the mail.

Everything went ok until, 911 occured and my regular payments didn't get through the mail on time, for awhile. Being on a fixed income, I had to wait to receive my income before I could send the payments in to be sure to avoid bank fees. When the payments failed to arrive through the mail in a timely fashion, as they had in the past; Providian started adding late fees and finance charges, immediately. I attempted several times to tell them that my payments had been great until, the mail was delayed; due, to homeland security's response to terrorist's threats on 911 and the postal services' response to focus on mail safety, with the threat of Anthrax.

Providian creditor associates wouldn't listen, to say the least. Then, my mother fell destitute and had to come live with myself and my family, which pushed my small income to the breaking point. The Providian CC fees began to grow exponentially and the costs of requiring to care for my mother, put me out of the ball park of even hoping to pay Providian any deal they offered. They refused any deal I could hope to manage. They required I pay for a mediator but, I couldn't afford to do so, any more than I could cover the overwhelming minimum payments. I attempted many times to get them to work with me, to close the account and stop all the fianance fees from growing out of control, etc. to no avail.

But, it was never about working with me! It was solely about their position as: The one's now in charge of me: (the dead-beat lady) and about harassing me, intimidating me, calling day after day, all hours of the day without notifying me it was Providian. When I would answer the phone, they would hang up and within a little while, it would happen all over again. Sometimes at 3 am they would call after a period of quiet or they would call over and over, all day long. As I am a Bi-polar Schitzophrenic Affective they nearly drove me into being committable permenently, just from the stress they inflicted. And Providian's associates just plain refused to meet me anywhere along the road of mediating any damages or finding a solution. I at this time, lived on SSI and AFDC and I still do, due to my disability.

The original Providian Accts. were Charged Off and resold several times to Affiliates of Providian for collections, and finally last year, (5+ yrs. later of the date of Charge off of the highest Providian CC), in 2006, to a supposed Credit Collections' Attorney?, with 1st Resolution Investment Corp.

This Attorney began trying to get me to pay the largest Providian debt, which had now risen to $14,010, through verbally shaming me and intimidation. I told him that I was on SSI and AFDC and was unable to make payment on the debt, especially, for such a sum of money. I was getting ready to file another bankruptcy but was advised not to. When the Attorney figured out that I wouldn't commit to any deal he offered; in retaliation, He proceeded to file a Civil Judgement against me. Once he filed, never informing me or having me served; (I think he might've filed in the wrong segment of court but, I can't be sure) and again, he filed and had someone serve me, after the court appearance date and too late for me to respond.

So now. as things stand, I have a Civil Judgement on my credit report that I do not know how to fix or if it can ever be removed. I have spent the last three years, avoiding CC's like the plague they are and attending College, in the hopes I might better my family's future out of it. I have been attempting to clean up what I can of my credit every since this mess began. My fiance' and I cannot marry, due to my ruined credit and he's disabled too. I am still receiving SSI and AFDC and unable to pay off Providian's henchman: First Resolution Investment Corp. , as I am not employable, at this time due, to my disability's reoccurance of relapse, recently. I have no phisical control as to when my mental illness will choose to harm me, as a person who has seizures can't control when they have one. I have endeavored to gain counseling and medication alteration, in the hopes to stabalize my disability again.

However, even were I a mentally stable person, at this time; I am afraid that if I were to start to get ahead, this Corp's. Attorney will just enforce his judgement and attach to anything we, as a family or myself, would have gained of value. He has the right to renew the judgement from 2006 and the present judgement itself, is not due to be removed off my credit report til 2013; When the original debts and the collections' affiliates records on my credit report say they are expected to come off next year at the end of 2008 and the other card in 2009.

So, this Attorney has effectively cercumvented my rights and the 7 yr. deadline for Providians' original debt to be removed after 7 yrs, increasing it to be on my report for a potential total of 26 yrs. This basically ruins my credit beyond repair and now I am afraid that when I might be able to go to work or gain some financial means, my income will be garnished until the judgment is resolved. I and my fiance' may never be able to marry due, to this threat over my/our heads or ever hope of owning anything of value, like a home of our own. Worse, I am afraid before the deadline for the other CC's occurs, that Providian will attempt to get a second judgement for the other CC I had with them, that is not expected to come off my credit report until 2009; Just because they can and have succeeded with one CC. If I were to remove the present judgement, they could still repeat this course of action again with the other card, before it is removed from my credit report.

I feel like I've been the victim of not only credit collection rights' violations but, opened up for Providian and this Attorney affiliate to stalk me for the next 20 yrs. in order to claim a debt that went out of control due, to events that were out of my control; both mentally and cercumstancially. I feel that Providian has gone beyond being a creditor; to being like the typecasted "Loan Sharks" that worked for the mafia mobsters in the historical USA history records!

I am at a complete loss and devistated, as to what hope I have of saving myself and my sanity, my dreams for my family, my hope for ever being able to marry my fiance', as well as, my credit future. I now have education loans. These businesses will be demanding their payments soon, as well. I know I will be struggling to pay them on my limited income, which is less than I was receiving, when I first got the Providian CC's. I am in fear of more Providian impact, down the road.

I have read that my SSI can't be garnished by CC companies and that an Attorney can't purchase a debt, to then collect on it but, since this Attorney seems to be connected to Providian, I do not know if this applies.

All I know is that my only bankruptcy was never this devistating and didn't take 26 years of my future, as blood money, like Providian and its' affiliates have. Yet, when I contacted a credit counselor, he told me not to file a bankruptcy, that it would harm my credit more, since my prior bankruptcy was still on my credit report, than if I let the Providian's debts fall off at 7 yrs. He may not have told me this, if he knew where I would be now with this mess. And it's too late now.

I want others to know to: Please avoid Credit Cards, as they impact way more than one's money! The Debts and the repercussions of that debt, can affect your personal life, your mental state and health, and any hopes you might've ever dreamed of. Material gain (stuff) is nothing to losses incurred regarding your good credit standing and your emotional well-being.

Providian and its' affiliates don't quit coming for you and/or your money and valuables! They haven't stopped coming after me to purposely ruin my credit, even if they know without doubt it wasn't my actions that put me here in the first place. It is all about Providian's and their affiliates' bottom line: profits and recovery of debts, at any cost!
